RESOLUTION NO. 5670
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, SETTING PRIORITIES FOR
FILING WRITTEN ARGUMENTS REGARDING A CITY MEASURE
AND DIRECTING THE CITY ATTORNEY TO PREPARE AN
IMPARTIAL ANALYSIS
WHEREAS, a Special Municipal Election is to be held in the
City of Arcadia on September 15, 1992, at which there will be
submitted to the voters the following measure:
SHALL THE ARCADIA CITY CHARTER BE AMENDED BY
ADOPTION OF REVISIONS TO VARIOUS SECTIONS
OF THE CITY CHARTER, AS FOLLOWS:
(1) Require that a person reside in the city and be a
registered voter and elector of the city when nomination papers
are issued for Councilmember eligibility.
(2) Authorize the city Council to determine when to
reschedule a meeting which falls on a holiday.
(3) Requires a City officer or employee to give up that
position if elected to a City of Arcadia office.
(4) Regarding City Boards and Commissions authorize action
by a majority vote of a quorum.
(5) Delete language that accords membership on the Recreation
,
Commission to representatives of agencies that contract with the
city relating to recreation or parks.
(6) Delete language that calls for a personnel representative
in the Classified Service.
(7) Eliminate all reference to specific gender by the
substitution of councilmember for Councilman.

(8) Authorize that violations of the Municipal Code be
misdemeanors or infractions and prescribe the misdemeanor penalty
to be that which is authorized by state Law.

NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That the City Council authorizes the Arcadia City
Council, Mayor George Fasching, Mayor Pro Tern Joseph Ciraulo,
Councilman Robert Harbicht, Councilman Dennis Lojeski and
Councilman Bob Margett, members of that body, to file written
arguments in favor of the City measure as specified above in
accordance with Article 4, Chapter 3, Division 5 of the Elections
Code of the State of California and to change the argument until
and including the date fixed by the city Clerk after which no
arguments for or against the City measure may be submitted to the
City Clerk.
SECTION 2. That the City Council directs the City Clerk to
transmit a copy of the measure to the City Attorney, unless the
organization or salaries of the office of the city Attorney are
affected. The City Attorney shall prepare an impartial analysis
of the measure showing the effect of the measure on the existing
law and the operation of the measure. If the measure affects the
organization or salaries of the office of the City Attorney, the
City Clerk shall prepare the impartial analysis. The impartial
analysis shall be filed by the date set by the city Clerk for the

filing of primary arguments.
SECTION 3. That the City Clerk shall certify to the adoption
of this Resolution.

I, JUNE D. ALFORD, City Clerk of the City of Arcadia, hereby
certify that the foregoing Resolution No. 5670 was passed and
adopted by the city Council of the city of Arcadia, signed by the
Mayor and attested to by the city Clerk at a regular meeting of
said Council held on the 19th day of May, 1992 and that said
Resolution was adopted by the following vote, to wit:
AYES: Councilmember Ciraulo, Harbicht, Lojeski, Margett
and Fasching
