HomeMy WebLinkAbout5960 RESOLUTION NO. 5960 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CONSENTING TO THE ESTABLISHMENT OF THE PORTIONS OF BALDWIN AVENUE AND MICHILLINDA AVENUE UNDER THE ATCHISON, TOPEKA AND SANTA FE (AT , SF) RAILROAD WITHIN THE CITY OF ARCADIA AS PART OF THE SYSTEM OF HIGHWAYS OF THE COUNTY OF LOS ANGELES FOR THE PURPOSE OF REPAIRING AND PERFORMING A SEISMIC SAFETY RETROFIT WHEREAS, the Board of Supervisors did on September 17, 1996, duly adopt a Resolution declaring the portions of Baldwin Avenue and Michillinda Avenue under the Atchison, Topeka and Santa Fe (AT & SF) Railroad, within the City of Arcadia, to be a part of the System of Highways of the County of Los Angeles, as provided under sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of California, for the limited purpose of repairing and performing a seismic safety retrofit of the bridges at the aforementioned locations; and WHEREAS, said Board of Supervisors by said Resolution requested this City Council to give its consent to allow the county to perform the above described improvements within said portions of said streets in the City of Arcadia described above; and WHEREAS, pursuant to Section 15301, Class 1 (d) of the California Environmental Quality Act (CEQA) Guidelines, the Secretary of Resources designated this type of project as categorically exempt. -1- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. Consent to Inclusion in County Hiqhway System. This City Council does hereby consent to the establishment of the portions of Baldwin Ayenue and Michillinda Avenue under the Atchison, Topeka and Santa Fe (AT & SF) Railroad, within the City of Arcadia, as part of the System of Highways of the County of Los Angeles as provided in Sections 1700 to 1704 inclusive of the Streets and Highways Code of the State of California, for the limited purpose of repairing and performing a seismic safety retrofit of the bridges at the aforementioned locations. SECTION 2. Findinq of Cateqorical Exemption. This City Council does hereby find that the project is categorically exempt from the requirement for an Environmental Impact Report pursuant to Section 15301, Class 1 (d), of the CEQA Guidelines. SECTION 3. Findinq of a Minor Nature. This City Council does hereby find that pursuant to Government Code Section 65402 (b), the aforesaid street improvements are of a minor nature and that, therefore, the provisions of said Section requiring submission to and report upon said project by the city Planning Agency do not apply. SECTION 4.
