HomeMy WebLinkAbout5976 RESOLUTION 5976 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ORDERING THE REORGANIZATION OF TERRITORY IDENTIFIED AS "MONROVIA REORGANIZATION, NO. 1-96 PARCELS 1 AND 2" TO THE CITY OF ARCADIA AND DETACHMENT FROM THE CITY OF MONROVIA. WHEREAS, a petition of application for the proposed reorganization of certain territory, identified as "Monrovia Reorganization, No. 1-96 Parcels 1 and 2" to the City of Arcadia and detachment from the City of Monrovia was filed with the Local Agency Formation Commission pursuant to the Cortese\Knox Local Government Reorganization Act of 1985 (Division 3 of Title 5 of the Government Code, commencing with Section 57000); and WHEREAS, on October 24, 1995, the City Council held a public hearing to consider a request filed by Bluth Development for a City Boundary Reorganization between the City of Monrovia and the City of Arcadia; WHEREAS, the City Council on November 21, 1995, adopted Resolution 5883 recommending approval of a boundary reorganization between the City of Monrovia and the City of Arcadia; and WHEREAS, the Local Agency Formation Commission on December 11, 1996, adopted Resolution 1996-67 approving "Monrovia Reorganization No. 1-96 Parcels 1 and 2", and authorized the City Council of the City of Arcadia to proceed with said reorganization; and WHEREAS, Pursuant to government code 56837 (100 percent landowner consent), the Local Agency Formation Commission authorizes the City of Arcadia to proceed without notice, hearing or an election to order said annexation, NOW, THEREFORE, BE IT RESOLVED as follows: Section I. The City Council finds the proposed reorganization will be in the interest of the City of Arcadia and the landowners and present and future inhabitants. Section 2. The reorganization identified as "Monrovia Reorganization, No. 1-96 Parcels 1 and 2", the legal description which is set forth in Exhibit A (including attached -1- 5976 map) attached hereto and incorporated herein, is approved and ordered without an election. Section 3. In compliance with the conditions set forth by the Local Agency Formation Commission in its Resolution 1996-67, the City Council hereby orders the annexation subject to the agreement signed by the property owner and agreed to by the City of Arcadia with specified development restrictions. Section 4. The City Clerk shall certify to the adoption of this Resolution.
