HomeMy WebLinkAbout1618 RESOLUTION OF INTENTION NO. 1618 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO n~PROVE PORTIONS OF HU!TTINGTON DRIVE IN SAID CITY OF ARCADIA, AND DECLARING SAID ~'!ORK OR IMPROVEUENT TO BB OF ~,\ORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK OR TICPROVEMENT AND TO BE ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF, AND DETERl1~INING THAT SERIAL BONDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EXPENSES AND FIX- ING A THiE FOR HEARING OBJECTIONS TO SAID WORK OR IMPROVE]2ENT, OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH. THE CITY COUNCIL OF TH E CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Arcadia, to order the following work and improvement to be done in said City of Arcadia, to wit: That an ornamental street lighting system, including poles, wires, conduits and other appurtenances be constructed on Huntington Drive between Second Avenue and Fifth Avenue. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution is shown on Profile and Improvement Plan No. C-172 on file in the office of the City Engineer of said City, to which Profile reference is hereby made for the des- cription of such grade. SECTION 3. All of the foregoing work shall be done in accordance with said Profile and Improvement Plan No. C-172 on file in the office of the City Engineer of said City of Arcad ia. All work on the construction of said ornamental street lighting system shall be in accordance with the following specifications on file in the office of the City Clerk of said City of Arcadia, to wit: "Specia& Specifications No.2 for the installation of lighting posts, wires, cables and other appurtenances on Huntington Drive between Second Avenue ,.'00 \"o~ a 11 and Fifth Avenue. All work on the construction and reconstruction of cement concrete shall be in accordance with the following specifications on file in the office of'the City Clerk of said City of Arcadia, to wit: "Standard Specifications No. o for the construction of curbs, sidewalks, gutter~, oil macadam and concrete pavement." All work on the construction and reconstruction of street pavement shall be in accordance with the following specifications on file in the office of th e City Clerk of said City of Arcadia, to wit: "Standard Specification No. 00 for the construction of asphaltic concrete pavement." Said Profile and improvement Plan No. C-172 and the Specifications hereinabove referred to were adopted by Resolution No. 1616 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolut- ion and are hereby referredfto for a more particular descript- ion of said work. All streets and avenues referred to in this Resolution are public streets and avenues of said City of Arcania. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and im- provement chargeable upon the District, which District said City Council hereby declares to be the District benefited by said work and improvement and to be'assessed to pay the costs and expenses thereof, which said District shall include all those lots in the said City of Arcadia, County of Los Angeles, State of California, fronting on said portion of Huntington Drive. -2- ,~ ,"',..... . A plat or map of said District indicating by a boundary line the extent of the lands included in the oroposed Assess- ment District, was approved and adopted by Resolution No. 1617 of the City Council of said City of Arcadia, and is on file in the office of ,the City Engineer of the City of Arcadia, Reference is hereby made to said plat or map for a further, full and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-44, and said map so on file shall govern for all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty-Five ($25.00) Dollars, or more, remaining unpaid for thirty (30) days after the date of the Warrant to represent the expenses of said work and improvement..' Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six (6%) per annum on all sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. Notice is hereby given that on Tuesday, the 6th day of May, 1947, at the hour of 8:00 o'clock, P.M. on said day, in the Council Chamber of the City Hall of said City of -3- J~ ~ Arcadia, any and all persons havin~ any objections to said proposed work or improvement or to the extent of the District to be assessed, or both, may ap,ear before said City Council and show cause why said proposed work or improvement should not be carried out in accordance with this Resolution. SECT ION 7. All oroceedings for the aforesaid 1"ork and improv!;lment and for the issuance of said Fonds shall be had and taken under and in accordance with the orovisions of an Act of the Le~islature of the State of California, known and gesignated as the "Improvement Act of 1911", be- ing Division 7, Streets and Highways Code of ~he State of California. SECTION 8. The report of the City Engineer, as required to be made by the orovisions of the Special Asses~ment, Investigation, Lirr.itation and Uajority Protest Act of 1931, being Division 4, Streets and Highways Code of the State of California, and the report on the hearing required to be held as provided in said Act, are on file in the office of the City Clerk of the City of Arcadia, are ooen to oublic inspection, and may be examined at his office in the City Hall of the City of Arcadia. SECTION 9. The Superintendent of Streets shall post or cause to be posted conspicuously along the line of said contemolated work or improve- ment and also along all the open streets ~ithin the District liable to be assessed and hereinabove described, notices of the passage of this Resolution in the manner and form required by law. SECTION 10. The City Clerk shall certify to the adootion of this Resolution and shall cause the same to be oublished twice in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arc~ria and hereby designated for that purpose; the City Clerk shall also wail notice of the adoption of this Resolution to all persons owning real property proposed to be assessed, whose names and addresses aopear on the last equalized assessrr.ent roll for City taxes, or as known to said Clerk.
