HomeMy WebLinkAbout1677 RESOLUTION NO.lb77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA. CALIFORNIA, APPROVING THE JOINT USE OF A PORTION OF SEWER SYSTEM BY THE CITIES OF ARCADIA AND SIERRA MADRE AND AUTHORIZING THE EXECUTION OF AN AGREEMENT THEREFOR. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1, WHEREAS, the City of Arcadia contemplates the construction of a sewer line in Oak View Lane in said City, and WHEREAS, the City of Sierra Madre has requested that it be permitted to connect with the northerly end of such sewer line and to use the same jointly with the City of Arcadia to its connection with the sewer proposed to be built by the Los Angeles County Sanitation District in Orange Grove Avenue, NOW. THEREFORE, BE IT RESOLVED that the City of Arcadia shall enter into an appropriate agreement with the "' City of Sierra Madre providing for and permitting the City of Sierra Madre to join to and connect with the Sewer hereafter to be constructed by the City of Arcadia in and along Oak View Lane in the City of Arcadia at a point approximately 246 feet south of Grand View Avenue thereon, upon the following conditions to-wi t: (a) The City of Sierra Madre will at its own expense con- struct and maintain a sewer extending frOM the City of Sierra Madre to the northerly end of the sewer constructed and maintain- ed in and along Oak View Lane as aforesaid; (b) The City of Sierra Madre shall enjoy the use of the said sewer in Oak View Lane to its connection with the sewer of The County Sanitation District in Orange Grove Avenue; (c) At the tiMe the sewer of the City of Sierra Madre is connected with the sewer of the City of Arcadia in Oak View Lane as aforesaid, the City of Sierra Madre will forthwith pay to the City of Arcadia the sum of $ ,t,L-o 0 0, ~ () J (d) Upon completion of the sewer to be constructed by the .. City o~erra Madre, through the County Sanitation District, in and along Orange Grove Avenue from the Easterly City boundary , -1- ~ ,,*"'09' thereon of the City of Sierra Madre to its intersection with Baldwin Avenue, the 6ity of Sierra Madre shall permit the City of Arcadia to make any necessary connections thereto; (e) Both Cities will cooperate fully in the construction, maintenance and use of sewer lines at any other necessary or convenient locations; (f) The cOMpensation to be paid by either City to the other, apart from the cOMpensation herein fixed for the first Mentioned sewer line in Oak View Lane, shall be determined by agreement between the Cities based upon the respective benefits accruing therefrOM. SECTION 2. The City Clerk shall certify to the adoption of this Resolution. I hereby certify that the foregoing Resolution was adopted at an adjourned regular meeting of the City Council of the City of Arcadia, held on the 30th day of June, 1947, on the affirmative vote of at least three CouncilMen, to-wit: AYES: CouncilMen NOES: o.
