HomeMy WebLinkAbout1486 RESOLUTION NO. 148b RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING CERTAIN WORK AND IMPROVEMENT TO BE DONE ON PORTIONS OF HUNTINGTON DRIVE AND FIRST AVENlJE, IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require that certain work and improvement be done in the City of Arcadia, and the City Council of the City of Arcadia hereby orders the same to be done in accordance with Specifications and Improvement Plan No. C-170 on file in the office of the City Engineer of said City of Arcadia, adopted for said work and under the direction and to the satisfaction of the Superintendent of Streets of said City of Arcadia; that Resolution of Intention No. 1479 heretofore adopted by this Council on the 18th day of June, 1946, contains a complete descrip- tion of the work and improvement to be done pursuant to this Resolu- tion and reference is hereby made to said Resolution of Intention No. 1479 for a complete description of said work and improvement. SECTION 2. That the grade to which the work hereinabove des- cribed shall be done and the improvement made as provided in this Resolution is shown on Profile and Improvement Plan No. C-170 on file in the office of the City Engineer of said City, to which Pro- file reference is hereby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in accord- ance with said Profile and Improvement Plan No. C-170 on file in the office of the City Engineer of said City of Arcadia. All work on the construction of said ornamental street lighting system shall be in accordance with the following specifications on file in the office of the City Clerk of said City of Arcadia, to-wit: "Special Specifications No. I for the installation of lighting posts, wires, cables and other appurtenances on Huntington Drive between - 1 - .,..t\ .f',.... Santa Anita Avenue and Second Avenue, and on First Avenue between Diamond Street and St. Joseph Street." All work on the construction and reconstruction of cement concrete shall be in accordance with the following specifications on file in the office of the City Clerk of said City of Arcadia, to-wit; "Standard Specifications No. 0 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement." All work on the construction and reconstruction of street pavement shall be in accordance with the following specifications on file in the office of the City Clerk of said City of Arcadia, to-wit: "Standard Specification No. 00 for the construction of asphaltic concrete pavement." Said Profile and Improvement Plan No. C-170 and the Specifica- tions hereinabove referred to were adopted by Resolution No. 1477 of said City Council of the City of Arcadia, and the same are here- by made a part of this Resolution and are hereby referred to for a more particular description of said work. All streets and avenues referred to in this Resolution are public streets and Avenues of said City of Arcadia. SECTION 4. Said City Council hereby determines and orders that Seven Thousand Five Hundred Dollars ($7,500.00), representing a por- tion of the cost and expense of the construction of the proposed orna- mental street lighting system on said portions of said public streets, as hereinabove specified, shall be paid out of the general fund of the City of Arcadia. SECTION ,. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary publiC benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District (except that portion of the cost of construction to be paid for by the City of Arcadia as specified herein) which District said City Council her~by declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses ther~of. A plat or map - 2 - of said District indicating by a boundary line the extent of the lands included in said District was approved and adopted by Resolu- tion No. 1478 of the City of Arcadia on the 18th day of June, 1946, and is on file in the office of the City Engineer of the City of Arcadia; reference is hereby made to said plat or map for a complete description of said District to be assessed to pay the costs and ex- pense of said work and improvement. SECTIO~ 2. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty- five Dollars ($25.00), or more, remaining unpaid for thirty (30) days after the date of the Warrant to represent the expenses of said work and improvement. Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the fifteenth day of the next October following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January, every year after the fifteenth day of the next October following their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six per cent (6%) per annum on all sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 7. All proceedings for the afo~esaid work and improve- ment and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designated as the "Improvement Act of 1911, being Division 7, Streets and Highways Code of the State of California." SECTION 8~ The Arcadia Tribune and Arcadia News, a weekly newspaper of general circulation, published and circulated in said City of Arcadia, is hereby designated as the newspaper in which notice of said work and improvement inviting sealed proposals shall be pub- lished in the manner and form and by the persons required by law. - 3 - SECTION 9. The City Clerk of said City of Arcadia is hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together with the Specifications therefor, inviting sealed proposals or bids for doing said work and said City Clerk is also directed to publish twice in said newspaper designated as afore- said in the manner and form required by law, a notice inviting sealed proposals or bids for doing said work, and referring to the Specifi- cations posted or on file. Said notice shall require a certified check or bond, either, as prescribed by law for an amount not less than ten per cent of the aggregate of the proposal. Said sealed proposals or bids shall be delivered to the City Clerk of said City of Arcadia on or before eight o'clock, P. M. on August 6. 1946; bias will be opened on said day and hour. SECT IOB-1Q. The City Clerk shall certify to the adoption of this Resolution. I hereby certify that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 16th day of July, 1946, by the affirmative vote of at least three Councilmen, to-wit: AYES: Councilmen, AdooCk, Cornyn, Nugent, Ormsby and Russell NOES: None ABSENT: None ~'r? ..d;.1!7 Ci ty Clerk .
