RE50LUTIOll OF TEE CITY COUNCIL OF THE CITY OF ARCADIA PROTESTING THE PAVING OF CERTAIN LAND IN THE CITY OF ARCADIA BY THE UNITED STATES DEPARTMENT OF AGRICULTURE AND THE DIVERSION OF STORl,j WATERS. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION I. WHEREAS, the United States Department of Agricul~ure is the owner and user of approximately ten (10) acres of land adjacent to north Santa Anita Avenue in the City of Arcadia, and ~~REAS, on July 10th, 1944, the United States Department of Agriculture gave formal notice to this Council of its intention to pave approximately 4.5 acres of s~~d acreage in accordance with a plan submitted to this Council with said formal notice, and VffirnREAS, this Council is informed that approximately 3.5 acres of said area is now paved or occupied by buildings, and ~rnEREAS. in said formal notice the United States Department of Agriculture stated that it tentatively planned to carryall storm water from said property into Santa Anita Avenue which, if done, will result in the storm waters from approximately 8 acres of land being carried into said street, and VVHEREAS. this Council is of the opinion that by the paving of said land together with that already ('~cover.ed~... the storm waters from the same will not be allowed to run off to the loose aluvial ground to the south, as it has heretofore done, and \~REAS, said area proposed to be paved and already paved is occupied by the United States Department of Agriculture for Federal Govern- ment purposes only, ~his City Council does not deem it to be the function or duty of the City of Arcadia, at its own cost, to provide facilities f~ the carrying of the excessive amount of storm waters resulting from an improvement made by the United States Department of Agriculture for its sole benefi t. NOW, THEREFORE, BE IT RESOLVED, that this City Council does here- by protest the paving of any additional land at said location or the diversion of any storm waters by the United States Department of Agriculture , --,-- for the reason that Santa Anita Avenue is designed to care for the normal amount of storm waters from streets and private driveways but is not de- signed to care for storm waters from extensive areas of pavement as pro- posed by the United States Department of Agriculture. BE IT FURTHER RESOLVED, that the City Clerk be and he is hereby instructed to file a certified copy of this Resolution with the Regional Forester of the United states Deparbnent of Agriculture at 760 Market St. San Francisco, California. SECTION 2~ The City Clerk shall certify to the adoption of this Resolution. I hereby certify that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 18th day of July, 1944, by the affirmative vote of at least three Councilmen, to-wit: AYES: CounCiLmen, Adcock, Billig, Leeper, Nugent and Ormsby NOES: None ABSENT: Non6 -~C~~~ Signed and approved this 18th day of Jullr , 1944.
