HomeMy WebLinkAbout1311 RESOLUTION NO. 1311. , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA GRANTING TO THE miITED STATES OF A1ffiRICA AN EXTENSION OF PERMIT TO nrSTALL AND MAINTAIN A SEWER LINE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. WHEREAS, on the 4th day of November, 1942, this City Council adopted Resolution No. 1220, entitled" A Resolution of the City Council of the City of Arcadia Granting a Permit to the United States of America to Install and Maintain a Certain Sewer Line in Said City.", granting to the United States of America a permit to install and maintain a sewer line across Huntington Drive, Huntington Drive Boulevard, and along Holly Avenue from the abandoned Southern Pacific Railway Right of Way to the northerly line of Live Oak, Avenue at its intersection with Holly Avenue, and WHEREAS, the permission to the United States of America to install and maintain said sewer line was granted upon condition that said permission granted should terminate as of the date the United States of America terminated its use of the Los An5eles Turf Club property in the City of Arcadia, and WHEREAS, pursuant to the permission granted in Resolution No. 1220 the United States of America did install and maintain and is now maintaining said sewer line in the City of Arcadia, along the route indicated in said Resolution No. 1220, and WHEREAS, the City of Arcadia, lmder date of September 5, 1944, was requested by S.N. Tideman, Jr., Major, Corps of Engineers, of the United States Army to grant to the United States of America an extension of said permit to operate and maintain said sewer line, NOW, THEREFORE, BE IT RESOLVED, that the United States of America is hereby granted an additional six (6) months time extending from the date which the United States of America terminates its use of the Los Angeles Turf Club property, in which to operate and main- tain said sewer line in the City of Arcadia, BE IT FURTHER RESOLVED, that that portion of the permit granted in Resolution No. 1220 heretofore adopted by this Council on November 4, 1942, which reads as follows: nBE IT FURTHER RESOLVED, -1- that the permission granted herein shall not be assignable and the right to maintain and operate said sewer line in said streets in the City of Arcadia shall terminate as of the date the United States of America terminates its use of the Los Angeles Turf Club property.II, be suspended for said period of six (6) months time extending from the date w~ich the United States of America terminates its use of the Los Angeles Turf Club property, but that after the extension of said six (6) months time all prOVisions of said Resolution No. 1220 shall again be in full force and effect. SECTION 2. The City Clerk shall certify to the adoption of this Resolution. I hereby certify that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 5th day of September, 1944, by the affirmative vote of at least three Councilmen, to-wit: AYES: Councilmen, Adcock, Billig, Leeper, Nugent and Ormsby NOES: Nora ABSENT: None J"" J-4'~~ ~r- , "/ City Clerk.
