A RESOLUTION OF THE CITY OF ARCADIA EXTENDING THE PERI OD OF TIME IN WHICH THE OPERATION OF A TURF CLUB AND HORSE RACING MAY BE RESUMED ON CERTAIN REAL PROPERTY IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, DOES RESOLVE AS FOLLOWS: SECTION 1. \rrlEREAS, by Ordinance No. 348 of the City of Arcadia, entitled "An Ordinance of the City Council of the City of Arcadia ronending Ordinance No. 170 of said City of Arcadia, approved March 3, 1926, pursuant to the provisions of Section 4 thereof." I adopted February 2, 1937, certain real property in the City of Arcadia more particularly described in said Ordinance No. 348 was excepted from the provisions of zoning Ordinance No. 170 of the City of Arcadia, adopted on March 3, 1926, and WHEREAS, said Ordinance No. 348 provides in part tllat should the business of operating a turf club and horse racing with pari-mutuel wagering on the results thereof be discontinued for a period of two years, then and in that case said property described in Ordinance No. 348 should revert to and become a district of Zone "Arr under said Ordinance No. 170 of the City of Arcadia, and WHEREAS, the right of the owner of said real property to operate a turf club and horse racing as defined in said Ordinance No. 348 of said City of Arcadia, was retained by said property owner under the provisions of zoning Ordinance No. 439 of the City of Arcadia, adopted June 28, 1940, and WHEREAS, by reason of the occupancy of said real property described in said Ordinance No. 348, by Military forces of the United States, the owner of said real property has been prevented from operating said turf club ~d horse racing as contemplated under the provisions of said Ordinance No. 348, and WHEREAS, the privilege to conduct a turf club and horse racing upon the real property as defined in said Ordinance No. 348 of the City of Arcadia was extended to and including the 2nd day of November, 1944, because of the fact it has been impossible to conduct a turf club and horse racing on said property by reason of the occupancy -1- 'I of said property by the United states Government for Military purposes, upon condition, however, that the owner of said property should pay all taxes due the City'of Arcadia before the delinquency date, and WHEREAS, the owner of said property did comply with the con- ditions provided in said Resolution in that it did pay all taxes due the City of Arcadia before delinquency date, and WHEREAS, the United States Government did occupy said turf club property for Military purposes up to and including the 30th day of September, 1944, and WHEHEAS, this Council is informed and believes that it will be necessary that extensive repairs and alterations be made on the buildings and grounds of said property before horse racing may be resumed thereon, which repairs and alterations are necessary to reconvert said property from a Military camp to its use for turf club and horse racing, NOW, THEREFORE, BE IT RESOLVED, that the privilege to conduct a turf club and horse racing upon the real property described in Ordinance No. 348 of the City of Arcadia is hereby extended for a period of one (1) year from and after the 2nd day of November, 1944, due to the fact that it has been impossible to conduct a turf club and horse racing on said property for more than one year last past by reason of the occupancy of said property by the United States Government for Military purposes, provided however, that such extension is conditioned upon the owner of said property paying all taxes due the City of Arcadia before delinquency date without protest. In the event such taxes are not paid as herein provided, this Resolution shall have no force and effect. SECTION 2.
