THE CITY COUNC IL 0:5' THE CITY OF ARCADIA DOES :mSOLVE AS FOLLO':/S: SECTION 1. That the public interest and convenience require that certain ITork and improvement be done in the City of Arcadia, and the City Council of the City of Arcadia hereby orders the Sillne to be done in accordance i"lith Specifications and Improvement Plan No. C-167 on file in the office of the City Engineer of said City of Arcadia, adopted for said work and under the direction and to the satisfaction of the Superintendent of Streets of said City of Arcadia; that Resolution of Intention No. 1327 heretofore adopted by tilis Council on the 8th . day of November, 1944, contains a complete description of the work and improvement to be done pursuant to this Resolution and reference is hereby made to said Resolution of Intention No. 1327 for a complete description of said work and improvement. SECTION 2. That the grade to which the work hereina00ve described shall be done and the i.mprovement made as provided in this ~esolution, is shown on Profile and Improvement Plan No. C-167, on file in the office of the City Engineer of said City to which Profile reference is hereby 'made for the description of such grade. SECTION 3. All of the foregoing work shall be done in 'accord- ance with said Profile and Improvement Plan No. C-167, on file in the office of the City Engineer of said City of Arcadia. All work on grading and the construction of concrete curbs shall be in accordance with the following Specifications on file in the office of the City Clerk of said City of Arcadia, to-wit: "Standard Specifications No. 0 for the construction of curbs, sidewalks, gutters, Oil Macadam pavement and concrete pavement." Said Profile and Improvement Plan No. C-167 and the Specifications hereinabove referred to were adopted by Resolution No. 1325 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for -1- a more particular description of said ~ork. All streets and avenues \ referred to in this Resolution are public streets and avenues of said Ci ty 0 f Arcadia. SECTION 4. That~~aid contemplated work and improvement in " , the opinion of the City Council of said City of Arcadia, is of more than local or ordinary public bBnefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, which District said City Council hereby declares to be the District benefited by said work and improve~ent and to be assessed to Jay the costs and expenses thereof, which said District is completely described in Resolution of Intention No. 1327, heretofore adopted by this Council on the 8th day of November, 1944, and to which Resolution reference is hereby made for a complete description of said District to be assessed to pay the cost and expense of said work and improvement. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty-Five ($25.00) Dollars, or more, remaining unpaid for thirty (30) days after the date of the Warrant to represent the expense of said work and improvement. Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the fifteenth day of the next October following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January, every year after the fifteenth day of the next October follow- ing their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six (6%) per cent per annum on all sums unpaid until the whole of said' principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. All of the proceedings for the aforesaid work and improvement and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designated as the "Improvement Act of 1911", approved April 7, 1911, and of all Acts supplementary thereto -2- or amendatory thereof. SECTION 7. The Arcadia Tribune and Arcadia News, a weekly newspaper of general circulation, published and circulated in said City of Arcadia, is hereby designated as the newspaper in which notice of said work and improvement inviting sealed proposals shall be published in the manner and form and by the persons required by law. SECTION 8. The City Clerk of said City of Arcadia is hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together with the Specifications therefor, inviting sealed proposals or aids for doing said work and said City Clerk is also directed to publish twice in said nerispaper designated as aforesaid in the manner and form required by law, a notice inviting sealed pro- posals or bids for doing said work, and referring to the Specifications posted or on file. Said notice shall require a certified check or bond, either,as prescr~Ded by law for an amount not less than ten per cent of the aggregate of the proposal. Said sealed proposals or bids shall be delivered to the City Clerk of said City of Arcadia on or before eight o'clock, P.!.!. on December 19, 1944. Bfuds will be opened on said day and hour. SECTIOn 9. The City Clerk shall certify to the adoption of this Resolution.
