A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING THE RULES AND REGULATIONS SUPH,El.1ENTING ORDINANCE NO. 431 OF THE CITY OF ARCADIA AND ORDINANCES HOS. 438 and 446 AMENDATORY THERETO. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That Section 2 of Rule VI. of the Rules and Regulations supplementing Ordi~ances Nos. 431, 438 and 446. creating the personnel system of the City of Arcadia, pursuant to ~ecommendation heretofore made by the Personnel Board of the City of Arcadia, be and the same is hereby amended to read as follows: SECTION 2. MILITARY SERVICE. When any employee in the competitive service is 0 rdered to seI'ITe in the Armed Forces of the United states he shall be considered to be on leave of absence and shall be reinstated to his fonner posi tion wi thout loss of seniority rights provided: 1. > Written application for reinstatement is filed with the Personnel Clerk and a copy thereof is filed with the Head of the Department from which the Em- ployee is on leave, within ninety (90) days after the termination of his military service; 2. Satisfactory proof of Honorable Discharge is furnished the Clerk of the Personnel Board and certification of such proof is filed by the Personnel Clerk with the Personnel Board 'and City Council; 3. Proof of sufficient mental and physical fitness for the duties of the job to which the employee is to be reinstated is submitted in the form of a certificate issued by a physician acceptable to the Personnel Board. Whenever it shall be necessary to dismiss any employee by reason of the reemployment of any former employee eligible to reemployment as provided in the Rules ~dRegulations then the employee within the Classification having served the least period of time shall be dismissed. SECTION 2. The City Clerk shall certify to the adoption of -1- this Resolution.
