RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ORDERIllG CERTAIN ';IORK AND ]}IPR01JE;,iENT TO BE IXJNE Oil A PORTION OF LAS FLORES AVENUE IN SAID CITY OF ARCADIA. THE CITY COUHCIL OF THE CITY OF ARCADIA DOES RESOLVE AS 1""L1O',,/S: SECTION 1. That the publiC interest and convenience require than certain work and improvement be done in the City of Arcadia, and the City Council of the City of Arcadia hereby orders the s~~e to be done in accordance with Specifications and Improvement Plan No. C-165 on file in the office of the City Engineer. of said City of Arcadia, adopted for said work and under the direction and to the satis- faction of the Superintendent of streets of said City of Arcadia; that Resolution of Intention No. 1384 heretofore adopted by this Council on the 19th day of June, 1945; contains a complete description of the work and improvement to be done pursuant to this Resolution and reference is hereby made to said Resolution of Intention No. 1384 for a complete description of said work and improvement. SECTION 2. That the grade to which the work hereinabove referred to shall be done ~d the improvement made as provided in this Resolution is mown on Profile and Improvement Plan No. C-165 on file in the office of the City Engineer of said City, to which Profile reference is hereby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in accord- ance with said Profile and Improvement Plan No. C-165 on file in the office of the City Engineer of said City of Arcadia. All work on GradinG and the construction of concrete cl~bs oold gutters shall be in accordance with thef'olloYling Specifications on file in the office of the City Clerk of said City of Arcadia, to wit, ItStand- ard Specifications No. 0 for the construction of curbs, sidevalks, 6utt~s, oil macadam pavement and concrete pavement.1t All work on the construction of oil macadam pavement mall be in accordance with the followin~ specifications on file in the office of the Ci ty Clerk of said Ci ty of Arcadi a, to wi t, "City of Arcadi a StanJard Specifications No.3 for the construction of 2-1/4 inch Oil -1- Uacadam Pavement and Resurfacing." Said Profile and Improvement Plan No. C-155 and the Specifications hereinabove referred to were adopted by Resolution No. 1382 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resoh:.tion and are hereby referred to for a !!lore partic\lar description of said ~ork. All streets and avenues referred to in this Resolution are public streets and avenues of said City of Arcadia. SECTION 4. Said City Council hereby determines and orders that Eight Hundred Seventy Five ($875.00) Dollars, representi~g a portion of the cost and expense of construction of oil macadam !,lavement and concrete Gutters on said portion o.f said public street, as hereinabove specified, shall be paid out of gasoline tax funds to be allocated to the City of Arcadia by the County of Los .~geles. SECTION 5. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, (except that portion of the cost of construction to be paid for by the City of Arcadia from gasoline tax f\Ulds as specified herein) which District said City Council hereby declareo to be the District benefited by said \7ork and improvement a~d to be assessed to pay the costs and expenses thereof. A plat or nap of said District indicating by a boundary line the extent of the lands included in said District waG approved and adopted by Resolution No. 1383 of the City of Arcadia on the 19th day of June, 1945, and is on file in the office of the City Engineer of the City of Arcadia; reference is hereby made to said plat or map for a complete description of said District to be assessed to pay the costs and expense of said work and improvement. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty-Five ($25.00) Dollars, or more, remaining unpaid for thirty (30) days after the date of the ':[arrant to repl'esent the expenses of said '.'lork and improvement. Said Serial Bonds shall extend over a poriod ending nine (9) years from the second day of January next succeeding -2- the fifteenth day of the next October following their date and &, even annual proportion of the principal sum thereof shall be payable by coupon on the second day of Janua~J, every year after t~e fifteenth dey of the next October follo~inG their date, until the vhole is paid, and the interest shall oe payable se~i-annually by coupon on the second days of January and July respectively of ec.ch year after their date at the rate of six (6%) per cent per annv~ on all sums unpaid until tte vhole of said principal and interest are paid. Said Bonds and inte~e3t thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTIOn 7. All proceedinGs for the aforesaid nork and improve- ment and for the issuance of said Bonds shall be had and taken under und in accordance \'Iith the provisions of an Act of the Le.;islature of the State of California, kno'.m and desi::;nated as the uIrnprovement Act of 1911, being Division 7, streets end Highvays Code of the State of California. II. SECTION" 8. The Arcadia Trihtine' and Arcadia NeVIS, a weekly newspaper of ::\eneral circulation, published and circuJa ted in said City of Arcadia, is hereby designated as the newspaper in which notice of said vlork and improvement invi tinE; sealed propo sals shall be pub- lished in the ma~~er ~~d fonn and by the persons required by law. SECTION 9. The City Clerk of said City of Arcadia is hereby directed to post conspiciously for five days, on or near the Council Chamber door of said Ci ty Council, in the manner and form required by law, a notice, together with the Specifications therefor, inviting sealed proposals or bids for doing said work and said City Clerk is also directed to publish twice in said newspaper designated as afore- . said in the manner and form required by law, a notice inviting sealed proposals or bids for doing said work, and referring to the Specifi- cations posted or on file. Said notice sh all require a certified check or bond, eithe~ as prescribed by law for an amount not less than ten per cent of the ag~regate of the proposal. Said sealed proposals or ~)ids shall be delivered to the City Clerk of said City of Arcadia on or before eight O'clock, P.],!. on -3- August 7, 1945; bids wi.ll be opened on said day and hour. ~ION 10. The City Clerk shall certify to the adoption of this Resolution. I hereby certify that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 17th day of July, 1945, by the affirmative vote of at least three Councilmen, to wi t: AYES: Councilmen, Adcock, Leeper, Nt~ent, Ormsby and Russell NOES: None ABSE;~T: None ~~ - Ci ty ex..
