RESOLUTION NO.l2l9 A RESOLUTION OF THE CITY COONCIL OF THE CITY OF ARCADIA EX- TENDING THE PERIOD OF TIME IN WHICH THE OPERATION OF A TURF CLUB AND HORSE RACING MAY BE RESUMED ON CERTAIN REAL PROPERTY IN THE CITY OF ARCADIA . THE CITY COONCIL OF THE CITY OF ARCADIA, DOES RESOJ:VE AS FOLLOWS: SECTION 1. vVHEREAS, by Ordinance No.348 of the City of Arcadia, entitled n An Ordinance of the City Council of the City of Arcadia amending Ordinance No.170 of said City of Arcadia, approved March 3, 1926; pursuant to the provisions of Section 4 thereofn, adopted - February 2, 1937, certain real property in the City of Arcadi~ more particularly described in said Ordinance No.348 was excepted from the provisions of zoning Ordinance No.170 of the City of Arcadia, adopted on March 3, 1926, and WHEREAS, said Ordinance No.348 provides in part that should the business of operating a turf club and horse racing with pari-mutual wagering on the re:lults thereof be discontinued for a period of two years, then and in that case said property des~ibed in Ordinance No. 348 should revert to a.nd become a district of Zone "An under said Ordinance No.170 of the City of Arcadia, and WHEREAS, the right of the owner of said real property to operate a turf club and horse racing as defined in said Ordinance No.348 of said City of Arcadia, was retained by said property owner under the provisions of zoning Ordinance No.439 of the City of Arcadia, adopted June 28, 1940, and WHEREAS, by reason of the occupation of said real property des- cribed in said Ordinance No.348, by Military forces of the United States, the owner of said real property has been prevented from operating said turf club and horse racing as contemplated under the provisions of said Ordinance No.348, NOW, THEREFORE, BE IT RESOLVED, that the privilege to conduct a turf club and horse racing upon the real property described in Ordinance No.348 of the City of Arcadia, is hereby extended for a period of one (1) year tram the date of this Resolution, due to the fact that it has been impossible to conduct a turf olub and horse racing -1- . on said property for more than one (l) year past by reason of the occupancy of said property by the United States Government for military purposes, provided, however, that such extension is condition- ed upon the owner of said property paying all taxes due the City of Arcadia before delinquency date without protest. In the event such taxes are not paid as herein provided, this Resolution shall have no force and effect. SECTION 2. The City Clerk shall certify to the adoption of this Resolution. I hereby oertify that the foregoing Resolution was adopted at a regula~ meeting of the City Council of the City of Arcadia, held on the -4th day of November, 1942, by the affirmative vote of at least three Councilmen, to-wit: AYES: Councilmen Adcock, Jones, Leeper, Nugent and Ormsby NOES: None ABSENT: None ~ ~LC ~ City Clerk Signed and approved this 4th day of November, 1942. ?M-r#<O~ May ATTEST: ~~). . ?,CI -
