Casalou, Human Resources Administrator 111■Cit_ SUBJECT: AUTHORIZE AND DIRECT THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH LIEBERT CASSIDY WHITMORE FOR FISCAL YEAR 2012-13 IN AN AMOUNT NOT TO EXCEED $42,000 FOR PERSONNEL LEGAL SERVICES Recommendation: Approve SUMMARY It is recommended the City Council authorize the City Manager to execute an agreement for personnel legal services with Liebert Cassidy Whitmore for Fiscal Year 2012-13 in an amount not to exceed $42,000. DISCUSSION The City has utilized the legal services of Liebert Cassidy Whitmore for many years. The expertise and services they have provided have been invaluable and have been of great assistance to the Human Resources Division. Specifically, the depth and diversity of their experience, coupled with their ability to provide practical applications to the myriad of laws in this area has proven extremely helpful, and give reason to continue the existing agreement. The current agreement provides a variety of employer-employee relations legal services including representation and expert advice on labor and employment related issues, as well as legal assistance with grievance and disciplinary matters. The attorney billing rates for Liebert Cassidy Whitmore ($180.00-$300.00 per hour) will remain the same during the term of the new agreement, which will expire June 30, 2013. AUTHORIZE THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH LIEBERT CASSIDY WHITMORE FOR FISCAL YEAR 2012-13 June 19, 2012 Page 2 of 2 FISCAL IMPACT If approved by the City Council, adequate funding has been allocated in the Fiscal Year 2012-13 Budget for the agreement with Liebert Cassidy Whitmore. RECOMMENDATION It is recommended the City Council authorize and direct the City Manager to execute an agreement with Liebert Cassidy Whitmore for Fiscal Year 2012-13 in an amount not to exceed $42,000 for personnel legal services.
