THE CITY COUNCIL OF THE CITY OF ARC~DIA, DCES RESOLVE AS FOLLO~ryS: SECTION 1. YffiEREAS. by Ordinance No. 34B of the City of Arcadia, entitled "An Ordinance of the City Council of the City of Arcadia amending Ordinance No. 170 of said City of Arcadia, approved March 3, 1926; pursuant to the provisions of Section 4 thereof", adopted February 2, 1937, certain real property in the City of Arcadia more particularly described in said Ordinance No. 34B uas excepted from the provisions of zoning Ordinance No. 170 of the City of Arcadia, adopted on March 3, 1926, and \lliEREAS, said Ordinance No. 34B provides in part that should the business of operating a turf club and horse racing ~ith pari-mutuel wagering on the results thereof be discontinued for a period of tuo years, then and in that case said property described in Ordinance No. 348 should revert to and become a district of Zone "A" under said Ordinance No. 170 of the City of Arcadia, and \nmREAS, the right of the owner of said real property to operate a turf club and horse racing as defined in said Ordinance Ro. 34B of said City of Arcadia, uas retained by said property ormer under the provlsions of zoning Ordinance No. 439 of the City of Arcadia. adopted June 28, 1940, and \1HEREAS, by reason of the occupation of said :r:ea~ !Jroperty described in said Ordinance No. 348, by Military forces of the United States, the ormer of said real property has been prevented from operating said turf club and horse racing as contemplated under the prOVisions of said Ordinance No. 34B, and E~REAS, the privilege to conduct a turf club and horse racing upon the real property as defined in said Ordinance No. 348 of the City of Arcadia mas extended to and including the 4th day of November, 1943. because of the fact it has been imnossible to conduct a turf club and -1- .. . ~ - - ho~se racing on said property by reason of the occupation of said property by the m1ited states Government for military purposes, upon condition, houever, that the ormer of said property should pay all taxes due the City of ~~cadia before the delinquency date, and \,HEREAS, the ouner of said property did comply \,i th the con- dition provided in said Resolution in that it dld pay all taxes due the City of Arcadia before delinquency date, and t~REAS, the United states Government still occu~,~ Baid turf clUb property for military purposes thereby preventing the ormer from operating a turf club and horse racing on said property. ~ NOW. THEREFORE, BE IT RESOLVED, that the privilege to conduct a turf club and horse racing upon the real property described in Ordinance No. 34B of the City of Arcadia, is hereby extended for a period of one (1) year from the date of this Resolution, due to the fact that it has been 1m possible to conduct a turf club and horse racing on said property for more than one (1) year past by reason of the occupancy of said property by the United States Government for military purposes, provided however, that such extension is conditioned upon the ovmer of said property paying all taxes due. the City of Arcadia before delinquency date uithout protest. In the e'lent such taxes are not paid as herein provided, this Resolution shall have no force and effect. SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
