A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, DENYING CONDITIONAL USE PERMIT
APPLICATION NO. CUP 12 -06 FOR A 580 SQUARE -FOOT
TUTORING CENTER FOR CHILDREN AGES 14 -18 WITH A
MAXIMUM ATTENDANCE OF 15 STUDENTS AT ONE TIME AT 909
S. SANTA ANITA AVENUE, UNIT - L.
WHEREAS, on March 29, 2012, a Conditional Use Permit application was filed
by Pi Tutorial for a 580 square -foot tutoring center for children ages 14 -18 with a
maximum attendance of 15 students at one time, Development Services Department
Case No. CUP 12 -06, at 909 S. Santa Anita Avenue, Unit - L; and
WHEREAS, a public hearing was held on June 12, 2012, at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development
Services Department in the staff report dated June 12, 2012 are true and correct.
SECTION 2. This Commission finds:
A. That the granting of such Conditional Use Permit will be detrimental to
the public health or welfare or injurious to the property or improvements in such zone
or vicinity because the on -site parking facilities are inadequate to support the
proposed tutoring center and the proposed business would intensify traffic at an
intersection that is already congested.
B. That the use applied for at the location indicated is properly one for which
a Conditional Use Permit is authorized; however, the applicant could not satisfy the

parking and traffic requirements for the requested conditional use as specified in
Section 9269.5 et seq. of the Arcadia Municipal Code.
C. That the site for the proposed use is not adequate in size and shape to
accommodate said use due to inadequate on -site parking and traffic congestion at
the adjacent intersection.
D. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use, but the
intersection of Campus Drive and Santa Anita Avenue is congested at peak times
and the proposed tutoring center would adversely impact this intersection. Also, the
on -site parking is insufficient to accommodate the proposed use.
E. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan. The proposed tutoring center is a commercial use
that is consistent with the General Plan Conditional Use Designation of the site.
SECTION 3. That for the foregoing reasons this Commission denies
Conditional Use Permit Application No. CUP 12 -06 for a 580 square -foot tutoring
center for children ages 14 -18 with a maximum attendance of 15 students at one
time, Development Services Department Case No. CUP 12 -06, at 909 S. Santa Anita
Avenue, Unit - L.
SECTION 4. The Secretary shall certify to the adoption of this Resolution.
