A Rli:SOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA DEOLARING ITS INTENTION TO IMPROVE A PORTION OF LONGDEN AVENUE IN , SAID aITY OF ARCADIA, AND DECLARING SAID WORK OR IMPROVE!I[ENT TO BE OF MORE THA~ LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK 'OR IMPROVEMEUT AND TO BE ASSESSED TO ,PAY THE COSTS AND EXPENSES THEREOF, AND DETERMINING THAT SERIAL BONDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EXPENSES AND FIXING ATIMt FOR HEARXNG OBJECTIONS TO SAID \roRK OR IMPROVEMENT, OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BarH. TEE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Arcadia, to order the following work and improvement to be done in said City of Arcadia, to-wit: That a concrete curb be constructed on each side of Longden Avenue from the Easterly line of Santa Anita Avenue to the Westerly line of Sixth Avenue, including cUrb De turns at Santa Anita Avenue and Longden Avenue. SECT~N 2. That the grade to which the work hereinabove desoribed shall be done and, the improvement made as provid,ed in this Resolution, is shown on Profile and Improvement Plan No. C-162, Sheet 1, on file in the 6ffic~ of the City Engineer of sai.dCi ty ,to which Profile reference is hereby made for the description of such grade. SECTION :3. All the foregoing work shall be dime in accoroance with said Profile and Improvement Plan No. C~162 on file in the office of the City Engineer of said City ~f Arcadia, All work on grading and the construction of concrete curbs shall be in accordance with the following Specifications on file in the office of the City Clerk of said City of Arcadia, to-wit: "Standard Specifications No. 0 for the construct;1on of curbs, sidewalks, gutters, Oil Macadam pavement and concrete pavement.H Said Profile and Improvement Plan No. 162, andth.-e Specifications hereinabove referred to were 'adopted by Resolution No., 1119 of said City Council of the City of Arcadia,' and ,the same are' hereby made a part , of this Resolution arid are hereby referred to for a more particular ./' description of said vork. -1- " ,. ,', All stree'ts and avenues referred to in this Resolution are public streets and avenues of said Cit)T of Arcadia. SECTIJN 4. That said contemplated work and improvement in the opinion of the City Council of said City of Arcadia, is of more than local or ordinary public benefit and said City eouncil hereby makes the expense of said work and improvement chargeable upon the District, which District said Cl ty Council hereby declares to be the District bene'fited by said work and improvement and to be assessed to pay the costs and expenses thereof, which said District is bounded and described as follows: All that portion of the said City of Arcadia, County of Los Angeles, state of California, included within the following described exterior boundary line, to-wit: Beginning at the intersection of the center line of Santa Anita Avenue with the Westerly prolongation of the Northerly line of Lot 46, Arcadia Acreage Tract, as shown On map recorded in Book 10, Page 18 of Maps, records of said County; thence Easterly ina " direct line to 'the Northeasterly corner of Lot 47 of said Tract; thence Northeasterly to a point in the Westerly line of Lot 106 of said Tract, . distant 445 feet Northerly from the Northerly line of Longden Avenue; thence Easterly parallel with and 445 feet Northerly from the Northerly line of Longden Avenue to the Easterly line of said Lot 106; thence Northerly along the Easterly line of said Lot 106, 2.5 feet, thence Easterly parallel with and 447.5 feet Northerly from the Northerly line of Longden Avenue and its Easterly prolongation, to the center line'of Sixth Avenue; thence Souj;herly along the center line of Sixth Avenue to its intersection with the Easterly prolon~ation of the Southerly line of Lot 2, Tract No. 8994, as shown on map recorded in Book 125, Page 43 of Maps, records of said County; thence Westerly in a direct line to the Southwesterly corner of Lot 1 of said, Tract; thence Northerly along the Westerly line of said Lot 1 to a point 300 feet southerly from the Southerly line of Longden Avenue; thence Westerly p~rallel with and 300 feet Southerly from the Southerly line of Longden Avenue to the Easterly line of Lot 49 of aforesaid Arcadia Acreage Tract; thence Southerly along the Easterly line of said ,Lot 49 to the Southeasterly corner thereof; thence Westerly along the -2:- ) , " - J ...- ~ , Southerly line of said Lot 49 and its Wester]y prolon')ation to the center line of Santa Anita; thence. Northerly thereon to the point of beginning. The foregoing description is general only. A plat or map of said District indicating by a boun1ary line tha extent of the lands in- cluded in the proposed Assessment District is on file in the office of the City Engineer of the City of Arcadia.. Reference is hereby made to said plat or map for a further, full and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-34, and said map so on f~le shall govern for all details as to the exterit of such Assessment District. SECTION 5. Sa,id City Council also dtermines and declareR that Serial Bonds shall be issued to represent each assessment of Twenty-Five ($25.00) Dollars, or mor~, remaining unpaid for thirty (~O) days after the date of the Warrant to represent the expenses of said work and improvement. Said Serial Bonds shall,extend over a period ending nine (9) years from the second day of January next succeeding the fifteenth day of the next October following their date" and an even annual proportion of the principal sum thereof shall be payable by coupon on the second .day of January, every year after the fifteenth day of the next October following their date, un~ilthe whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of sillt (6%) per cent per annum on all'sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. Notice is hereby day of July, 1941, at the hout' of ~' given that on Tuesday, the 15th o'clock, ~M.~ of said day, in the Council Chamber of the City Council of said City of Arcadia, -3- 0:-;=-. in the ,city Hall of said City, any and all persons having any objections to said proposed ,work or improvement or to the extent of the District to be assessed, or both, may appear before said City Council and show cause why said proposed work or improvement should not be carried out in accordsnce with th~s Resolution. SECTION 7. All of the proceedings for the aforesaid work and nnprovement and for the issuance of said Bonds shall be had and taken under and in accordance with 'the provisions of an Act of the Legislature of the State of, California, known and ~esignated as the "'Improvement Act of 1911", approved April 7, 1911,and of all Acts supplementary there~o or amendatory thereof, SECTION 8.' The Superintendent of Streets shall post or cause to be posted conspicuously along the line of said contemplated work or imprQvement and slso along all the open streets within the District liable to be assessed and hereinabove described, notices of the passage of this Resolution in the manner and form required by law. SECTION 9. The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be published twice in the Arcadia Tribune and Arcadia News, a newspaper of generalcircuiation, published and circulated in the City of Arcadia and hereby designated for that purpose; the City Clerk shall also mail notice of the adoption of this Resolution to all persons owning rea~ property proposed to be assessed, whose names and addresses appear on the mast equalized assesi?)!Ient ,roll for City , taxes, or as known to said Clerk. Such notice shall be given in the manner and form required by said "Improvement Act of 1911" approved April 7, 1911, and of all Acts supplementary thereto or amendatory thereof. The foregoing Reso,lution of Intention was adopted 'at a regular meeting, of. the City Council of, the City of Arcadia, held on the 17th day of Jurie, 1941, by the affir.mative vote of at least three CounCilmen, to-wit: AYES: councilmen".Adcock, Bolz, Leeper and Ormsby.
