A RESOLUTION OF THE CITY COUNCIL OF 'I'HE CITY OF ARCADIA DECLARING ITS INTENTION TO IMPROVE FORT IONS OF T~NTH AVENUE AND CAMINO REAL.IN SAID.CITY OF ARCADIA, AND DECIARING SAID WORK fiR I~- PROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT 'AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAItrWORK OR IMPROVEMENT AND TO BE ASSESSED TO .PAY THE COSTS AND EXPENSES THEREOF, AND DETERMINING THAT SERIAL BONDS SHALL BE ISSUED TO REPR~SENT SAID COSTS AND EXPENSES AND FIXING A TIME FOR HEARING OBJECTIONS TO SAID WORK OR IMPROVEMENT, OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH. - THE CITY COUNCIL OF THE CITY. OF ARCADIA DOES RESOLVE AS FOLLO;/S: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Arcadia, to order the following work and impr~vement to be done in said City of Arcadia, to-wit: First: That a concrete curb be constructed on each side of Tenth Avenue from the northerly City boundary line to the southerly City boundary line, including curb returns at El Norte Avenue and Tenth Avenue, El .Sur Avenue and Tenth Avenue, Camino Real and Tenth Avenue and ~effries Avenue and Tenth Avenue, Second: That a concrete eurb be constructed on each side of Camino Real from Fourth Avenue to. Tenth Avenue, inoluding a curb return at Fourth Avenue and Camino Real, excepting therefrom 254.5 feet in and adjacent to the Santa Anita Wash Channel. SECTION 2. . That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution, is shown on Profile and Improvement plan No. C-163, Sheets 1 and 2, on file in the office of the City Engineer of said City, to which Profile reference is hereby made for the description of such g>>ade. SECTION 3. All the foregoin3 work shall be done in accordance with said Profile and tmprove~ent Plan No. C-163, sheets 1 and 2, on file in the office of the City Engineer of said City of Arcadia, All work on grading and the construction of concrete curbs shall be in accordance With the following Specifications on file in the office. of the Cit:>'" Clerk of said City of Arcadia, to-wit: "Standard Specifications No. 0 for the construction of curbs, sidewalks, gutters, Oil Macadam pavement and concrete pavement.n Said Profile and Improvement Plan No. C-163, Sheets 1 and 2, and the Specifications hereinabove ~eferred to were adopted by Resolution -1- ~ ,.. ~ J ~ No. 11~~ of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more particular description of said work. All streets and avenues referred to in this Resolution are public streets and avenues of. said City of Arcadia. SECTION 4. That said contemplaued work and improvement in the opinion of the City Council of said City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expen$e of said work and improvement chargeable upon the District, which District said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which said District is b~unded and described as follows: All that portion of the said City of Arcadia, County of Los Aneeles, state of California, included within the following described exterior boundary line, to-wit: Beginning at the intersection of the center line of Fourth Avenue with the Westerly prolongation of the Northerly line of Lot 43, Tract No. 808, as shown on map recorded tn Book 16, Pages 82 and 83 of Maps, records of said County; thence Eaaterly in a direct line to the northeasterly corner of Lot 75 of said Tract No. 808; thence Northerly in a direct line to- the intersection of the Westerly line of Lot 84 of said Tract No. 808 with the Norther~y Boundary Line of the City of Arcadia; thence Easterly along said Northerly Boundary Line to the Northeasterly corner of Lot 14, F.A. Geier Tract, as shown on map recorded in Book 23, Page 40 of Maps, records of said County; thence Southerly parallel with and 447.92 feet Easterly from the Easterly line of Tenth Avenue to the southerly line of Lot 34 of said F.A.Geier Tract; Thence Easterly along said southerly line of Lot 34 to the Southeasterly City Buundary Line; thence Southwesterly thereon to its intersection with the southerly line of Lot 131, Arcadia Acreage Tract, as shown on map recorded in Book 10, Page 18 of Maps, reccrds of said County; thence Westerly along the Southerly line of said Lot 131t6 the Southwesterly corner thereof; tl~nce Northerly along the Westerly line of said Lot 131 to a point distant 447.5 feet southerly from the southerly line of Camino Real; thence Westerly parallel with and 447.5 feet -2- - ~ - . Southermy from the Southerly line of Camino Real to the Westerly line of Lot 113 of said Arcadia Acreage Tract; thence Northerly in a direct line to the place of beginning. The foregoing description is general only. A plat or map of said District indicating by a boundary line the extent of the lands included in tbe proposed Assessment District is on file in the office of the City Engineer of the City of Arcadia. Reference is hereby made to said plat or map for a further, full and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-35, and said map so 1m file shall govern for all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty-Five ($25.00) Dollars, or ~ore, remaining unpaid for thirty (30) days after the date of the Warrant to represent the expenses of said work and improvement. Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the fifteenth day of the next October following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January, every year after the fifteenth day of the ne~t October following their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each ~ar aft.er their date at the rate of six (6%) per cent. per annum on all sums umpaid until the whole' of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. Notice is hereby given that on Tuesday, the 5th of ~ OICIOCk,.~ M~, of said day, in ~ day of August, 1941, at the hour the Council Chamber of the City Council of said City of Arcadia, in the , , . SECTION 7. All of tbe proce~dings for the afbresaid work and :Improvement and for the issuance of said Bonds s'hall be had; and taken under and in accordance with the provisions of an Act of the Legislature of the .State of California, known and designated as tbe "Improvement Act of 1911", approved April 7, 191iL, an<;l of a11Acts supplementary thereto or amend~tory thereof'. SECTION 8. The Superintendent of Streets sball post or cause to be posted conspicuously along the line of said contemplated work or improvement and also along all the open streets witbin the District liable to be assessed and hereinabove described, notices of the passage of this Resolution in the manner and form required by law. SECTION 9. The City, Clerk shall ,certify to the adoption of thl$ , ' Resolution and shall cause the same to be published twice in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia and hereby designated for that purpose; the City Clerk shall also mail notice of the adoption of this Resolution to aIm persons owning real property proposed to be assessed, whose names and addresses appear on the last 'equalized assessment roll ,for City ,taxes, or as known to said Clerk. Such notice shall be given in the manner and form requiped by said "Improvement Aot of19il" approved April 7, 1911, and of all Acts supplementary thereto or amendatory thereof. The foregoing Reselution of Intention was adopted at a regular meeting of the City Council of the City of Arcadia, held on the l~day of Julv , 1941, by the affirmative vote of at least three Councilmen, to-wit: AYES: Councilmen, Adoock, Bolz, Leeper, Ormsby and Perkins.
