A RESOLUTION OF THE CITY COUNCIL OF TBECITY OF ARCADIA ORDERING CERTAIN WORK AND IM;PROVEMENT TO BE DONE ON PORTIONS OF TENTH AVENUE AND CAMINO REAL IN SAID CITY OF ARCADIA. TirE OITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. Taat tHe public interest and convenience req~ire that certain work and :Improvement be done in the City of Arcadia, and the City Council of the City of Arcadia sereby orders the same to be done in accordance with Specifications and Improvement Plan No. C-163, sheets 1 and 2, on file in the office of the City Bng~neer of said City of Arcadia, adopted for said work andunder,tme direction and to the satisfaction of the superintende~t of Streets of said City of Arcadia; that Resolution of Intention No. 1131 heretofore adopted by this CO.Uhcil on the 1st day of July, 1941. contains a complete description of the work and improvement to be done pursuant to this Resolution and reference is hereby made to said Resolution of Intention No. 1131 for a complete description of said work and 1mprovement. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvemept made as provided in this Resolution, is shown on Profile and Improvement Plan No.C163, Sheets 1 and 2, on file in the office of the City Engineer o.f said City to which Profile reference is hereby made for the description of such grade. SECTION 3. All the foregoing work shall be done in accordance with said Profile and Improvement Plan No. 0-163, sheets land 2, on file in the office of the City Engineer of said City of Arcadia. All work on grading and the construction "of concrete curbs shall be in accOrdance with the following Specifications on file in the office of the City Clerk of said. City, of Arcadia, to-wit: "Standard Specifications No. 0 for tbe construction of curbs, sidewalks, gutters, Oil Madadam pavement and concrete pavement." Said Profile and Improvement Plan No. C-l63, Sheets 1 and 2, and tAe Specifications aereinabove referred to were adopted by Resolution No. 1123 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referrea to for a more particular description of said work. -1- - ' .... .- -.... ,. All streets and avenues referred to in this Resolution are public streets and avenues of said City of Arcadia. SECTION 4. That said contemplated work and improvement in tbe opinion of the City Council of said City of Arcadia, is of more than local or ,ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, whicB District said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay tae costs and expenses thereof, which said District is completely described in Resolution of Intention No. 1l3l, aeretofore adopted by this Council on the 1st day of July, 1941, and to which Resolution reference is hereby made for a complete description of said District to be assessed to pay the cost and expense of said'. work and improvement. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty- Five ($25.00) Dollars, or more, remaining unpaid for thi~ty (30) days after the date of the warrant to represent the expemses of said work and improvement. Said Serial Bonds shall extend ove~ a period ending niRe (9) years from the second day of January next succeeding the fifteenth day of the next October following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January, every year after the fifteenth day of the next October following thelrdate, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six (6%) per cent per annum on all sums unpaid until tbe whole of said principal and interest. are paid. Said Bonds and interest thereon shall be payable at the office of the City Traasurer of the City of Arcadia. SECTION 6. All of the proceedings for the aforesaid work and improvement and for tBe issuance of- said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature 9f the State of California, known and designated as the "Improvement Act of 1911", appr.oved April 7, 1911iand of all Acts supplementary thereto or amendatory thereof.. "2" .,. , SECTION 7. The Arcadia Tribune and Arcadia News, a weekly newspaper of general circulation, published and circulated in said City of Arcadia, is hereby designated as the newspaper in which notice .of said work aQd improvement inviting sealed proposals shall be published in the manner and form and by the persons required by law. SECTION 8. Tbe City Clerk of said City of Arcadia is hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together with tbe Specifications therefor, inviting sealed proposals or bids for doing said work and said City Clerk is also directed to publish twice in said newspaper designated as aforesaid in the manner and form required by law, a.notice inviting sealed pro- posals or bids for doing said work, and referring to the Specifications posted or on file. Said notice shall require a certified check or bond, either, as prescribed by law for an amount not less ,than ten per cent of the aggregate of the proposal. Said seq1ed proposals or bids shall be delivered to the City Clerk of said City of Arcadia on or before eight o'clock, P.M. ~~ /q(!-/4Jf-1 . Bids will be opened on said day and ~our. d SECTION 9. The City Clerk shall certify to the adoption of this Resolution.
