RESOLUTION NO. 1024.
A RESOLl~ION OF THE CITY COUNCIL OF THE CITY OF ARCADIA
ACKNOI"lLJ!:DGING THE PRESENTATION OF THE DE!.lAND OF BURKE, HICKSON, BURKE
& j,IARSHALL AND REFUSING TO AUDIT, ALLOII OR PAY THE SAlm.
THE CITY COUNCIL OF THE CITY OF ,ARCADIA DOES RESOLVE AS
E'OLLOI'IS:
SECTION :,. WHEREAS, the firm of Burke, Hickson, Burke &
Marshall, Attorneys at Law, was employed by Resolution No. 996 to act
as special counsel :~or such of the defendants who desired to avail
themselves of such representation in those certain actions entitled
"Roosevelt, et ux, vs. Griffitts, et aI," No. 444392, and "Roosevelt
vs. Griffitts, et aI," No. 444393, both actions being in the Superior
Court of thls County, and to do and perform all legal services necessary
and proper In the defense of said actions, said Resolution also providing
that the necessary and proper costs expended in the defense thereof shall
be paid by the City of Arcadia, reference being hereby made to Resolution
No. 996 for fuller particulars thereof, and
lillEREAS, all of the defendants in said actions, except City
Attorney James C. Bone and City Judge Ardene Boller have availed them-
selves of such representation, and
\nrn~AS, said firm has performed legal services which were
necessary and proper in the defense of said actions and has expended
necessary and propllr costs in connection therewith in the amounts
specified in the dllmand of said firm herein mentioned, and
ImEREAS, said firm has presented its demand dated the
30th day of J anuar:/" 1940, in the total amount of ONE THOUSAND SEVENTY
THREE ($1,073.00) JOLLARS, a co~y of which is attached hereto, and
\/HEREAS, said demand a!)ainst the City of Arcadia was presented
in due and proper form and in accordance with the regulations of the City
Council of the City of Arcadia, and
WHEREAS, the City of Arcadia has in its General Fund sufficient
moneys to pay said demand, and
'\/lfEREAS, said City Council is advised by City Attorney Bone
that the propriety of the payment of said demand should be litigated,

NOI'l, THEREFORE, the City Council of the City of Arcadia
hereby resolves:
(1) That said demand of Burke, Hickson, Burke & Marshall
is hereby rejected, refused and disallowed.
(2) That Oity Attorney James C. Bone is hereby instructed to
defend any action brought upon said demand a~ainst the City of Arcadia.
SECTION 2,. The City Clerk shall certify to the adoption of
this Resolution.
I hereby certify that the foregoing Resolution was adopted
at a regular m:leting of the City Council of the City of Arcadia, held
on the 20th day of
February
,1940, by the affirmative vote of
at least three Comlcilmen, to-wit:
