S~CTION ~. That the public interest and convenience require,
and it is the intention of the City Council of the City of Arcadia to
order the followin~ change or modification of ~rades in the following
public streets in the City of Arcadia, to-uit:
First: That the ~rade of Huntin1ton Drive at or adjacent
-) to its intersection. \"lith the ri::;ht-of-way of the Atchison'~ Topeka and
Santa Fe Rai I';: ay , includin~ its inte"sections l1ith Indiana Street,

Second Al'enue and Third Avenue, be chan~ed or modified as shorm on that
certain plan for the ~rade senaration of Huntin~ton Drive and the Atchison,.
Topeka and Santa Fe Railuay tracks, proposed by the State of Callf0rnia
Depart~ent of Public \!orks, Division of TIi::;h1.:ays, and approved by the
City Council of the City of Arcadia, on I';arch 5, 1940, which said plan Is
on file in the office of the City En3ineer of the City of Arcadia, des-
i~nated as Plan B-5-84, and uhich plan is by reference thereto made a
part of this ~esolution, and is available for inspection in the office of
the City En3ineer of said City.
Second: That the Grade of First Avenue at or adjacent to its
intersection \7ith the risht-of-way of the Atcl1iaoif';.. Topeka and Santa
Fe Rail~ay, includin~ its intersections uith Scnta Clara Street and
Indiana Street, be chan~ed or modified as shorm on said Plan B-5-84
described and on file as mentioned herein.
SECTION 2. All of the proceedin3s of the aforesaid chan~e
or modification of 3rades in said streets shall be had and taken under
and in accordance with the provisions of an Act of the legislature or.
the State of California, kno\!n and desi~nated as the ChanGe of Grade
Act of 1909, Statutes 1909, pa1e 1018, and of all Acts supplementary
theroto or amendatory thereof.
SECTION 3. The City Clerk of said City of Arcadia is hereby
directed to post conspicuously for two days on or near the Council Chamber

door of said City Council, in the manner and form required by lcw, a
true copy of this Resolution; the Arcadia Tribune and Ne~s, a weekly
ne':'1spaper of ..~ener~.l circl.'.lation, published and circulated in said City
of Arc('.[~ia, is hereby desi.~nated as the nerIS 'o.per in 'which tl'.s Resolution
of InteDtion shall be published, in the manner and form as required b:
law. The City Clerk is hereby directed to Dublish twice in said newspaper
desi~uted as aforesaid, this Resolution of Intention.
SECTION ~. The Street Superintendent shall post, or cause
to be posted conspicuously alon~ each of said streets or portions
thereof where such ctanse or modification of 3rades is proposed to be
made, as provided in this Resolution of Intention, at not more than
One Hundred (1001) feet in distance apart, notices, but not less than
three (3) in all, of the passaGe of this Resolution of Intention, in the
manner and form r.3quired by law. The Street Superintendent shal1 also
cause a notice sunilar in substance to ~e published by two insertions
in the Arccdin Trtbune and 1-Jews, desL;nated published and circulated
as foreesaid.
SECTION 5. The City Clerk shall certify to the adoption
of this Resolution.
I hereb;r certify that the foregoin~ Resolution was adopted
at a re~ular meet:nG of the City Council of the City of Arcadia, held
on the 2nd day of April

three Councilmen, to-wit:
