RESOLUTION NO. 1038
A RESOLUrION OF THE CITY COUNCIL OF THE CITY OF ARCADIA CANVASSING
THE RESULTS OF GEN:S:RAL MUNICIPAL ELECTION HELD IN SAID CITY OF ARCADIA ON
THE 9TH DAY OF APRIL, 1940.
THE OITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS:
WHEREAS, at a general municipal election held in the City of
Arcadia, County of Los Angeles, State of California, on Tuesday, April
9, 1940, pursuant 1;0 law and the provisions of Resolution No. 1031 of said
Oi ty Council of thEI City of Arcadia., the whole number of voters voting
thereat was 2710, and the whole number of legal votes cast was 2709, and
WHEREAS, due notice of said municipal election was given and
said election was ~eld at the time and in the manner and in all respects
as required by said Resolution No. 1031, and that in all particulars not
rec:lted in said Resolution, said election was held as provided by law for
the holding of general municipal elections in cities of the fifth and
si~th class, and
WHEREAS, said municipal election was legally and fairly conducted,
an6 the returns thereof were duly and regularly made and certified to this
Council end said returns have been fully and regularly canvassed by this
Council, and
wHEREAS, at said municipal election the persons hereinafter
named received the .following votes for the respective office for which
they were candidatea:

WHEREAS, . Ilt said municipal election the votes cast for and against
the propositions hereinafter specified were as fol1ows:
(a) "Sha::'l the City of Arcadia adopt an Ordinance creating and
establishing the office of City Manager of the City of Arcadia, defining
his powers, prescribing his duties, fixing his compensation in a sum not less
than Five Thousand ($5,000) Dollars per annum, providing for the appointment
by him of a Secretary or Secretaries at such compensation as may be fixed by
the City Council, which Ordinance is defined and ordered submitted in Ordinance
No. 427 of the City Council of said City?"

NOW, THEF~FORE, BE IT RESOLVED, that the following named persons,
having received the highest number of votes for the office for which they
were candidates, be and they are hereby declared duly elected as follows:

BE IT FUR'I'ID:R RESOLVED;
(a) That the proposition "Shall the City of Arcadia adopt an
Ordinance creating and establishing, the office of City Manager of the City
of Arcadia, defining his powers, prescribing his duties, fixing his com-
pensation in a sum not less that Five Thousand ($5,000) Dollars per annum,
providing for the ap?ointment by him of a Secretary or Secretaries at such
compensation as may be fixed by the City Council, which Ordinance is defined
snd ordered submitted in Ordinance No. 427 of the City Council of said City?"
having failed to recoive a majority vote in the affirmative, said proposition
is hereby declared dElfeated.
(b) That the proposition "Shall the City of Arcadia adopt Ordinance
No. 424 entitled 'An Ordinance of the City Council of the City of Arcadia
amending Ordinance No. 170 of said City by adding thereto three new sections
to be known and numbered as Section 5-H, Section 7-G and Section 8-E'
rezoning certain propsrty in the City of Arcadia from residential zone to
business zones?" having failed to receive a majority vote in the affirmative,
said proposition is hereby declared defeated.

The City Clerk shall enter on the records of the Council a
statement of the results of said election showing the whole number of
votes cast in said election; the names of the persons voted for; the office
for which each person was voted for; the propositions voted upon; the
number of votes cast in each precinct and by absentee votes to each of said
persons and on each of said propositions, and the total number of votes
cast in said election for each of said persons, and the term for which
. each of said person:l was elected, and the total number of votes cast for
and against each of said propositions.
The City Clerk shall certify to the adoption of this Resolution:
I hereby c.ertify that the foregoing Resoluion was adopted at an
adjourned regular meeting of the City Council of said City of Arcadia,
held on the 15th day of Apri~ 1940, by the affirmative vote of at least
three (3) Councilmen, to-wit:
AYES: Councilmen Bolz, Griffitts, Leeper, Perkins and Walter
