THE CITY C01JllCIL OF TIm CITY OF ARCADIA DOES RZSOLVE AS FOLLO'.:S : SECTIon 1. ,."ru::UAS, the City Council, on the 2nd day of April, 1940, adopted a Resolution of Intention, ITo. 1035, declaring its intention to change or modify the grade in portions of Huntington Drive and First Avenue in the City of Arcadia, under the provisions of an Act of the Legislature of the state of California, knOt~ and desi~nated as the ChanGe of Grade Act of 1909, Stat. 1909, page 1018, and D~~=AS, the time of filin~ protests a;ainst said change of 3rade has expired, and ~'rnG~:AS, the time for hearing said ~'otests was heretofore set for May 8, 1940, at 8:00 o'clock, P.M. in the Council ChwJber of the City Hall of said City, and :mBREAS, no protests uere filed a~ainst such chan~e or modification of grade, NO~, TH2R~FORE, be it resolved as follows: First: That the grade of Huntineton Drive at or ~djacent to it!) intersecti'Jn \"lith the ri~t-of-'1ay of the Atchison, Topeka and Santa Fe Railuay, including its intersections with Indiana Street, Second Avenue and Third Avenue, be changed or modified as sho,vn on that certa1n plan for ~he srade separation of Huntin~ton Drive and the Atchison, Topeka and Santa Pe Rail'Jay t!'acks, proposed by the State of California, Department of Public ':forks, Division of Hislmays, and a:-:l'roved by the City {:ouncil of the City of Arcadia, on l:arch 5, 1940, which said plan is on file in the of;:ice of the City Engineer of the City of Arcadia, des- ignated as Plsn B..5-84, and vlhich plan is by reference thereto made a part of this Res03.ution, s.nd is available for inspection in the office of the City En3ineer of said City. Second: That the grade of First Avenue at or adjacent to its intersection with tho right-of-way of ~he Atchison, Topeka and Santa Fe Railuny, includ.inG its intersections tlith Santa Clara Street and I;miana Street, be chanced or modified ss shovm on said Plan B-5-84 described and on file as mentioned he!'ein. -1- \"',~.... The Arcadia Tribune and Ne\'ls, a \'leekly ne\'lspaper of General circulation, published and circulated in said City of Arcadia, is hereb;r desiGnated as the ne\'lspaper in which this Resolution shall be publil3hed, in the manner end form as required by Law. The City Clerk is hereblT directed. to pUblish once in said ne,;"lspaper desiGnated as aforesaid, this Resolution. SECTION~. The City Clerk shall certify to the adoption of this Resolution.
