HomeMy WebLinkAbout2260 " -;'(~~ :1- ~ESOLUTION NO.2260, S' &' A RESOLUTI~N OF THE CITY COUNCIL OF THE CITY 1~ ,3 0 OF ARCADIA, CALIFORNIA, DEFINING THE TEPJ~ "FOSTER HOME" AND SPECIFYING THE ZONES IN WHICH AND CONDITIONS UPON f{HICH FOSTER HOMES MAY LAW- FULLY BE CONDUCTED UNDER ORDINANCE NO.76o OF THE CITY OF ARCADIA. WHEREAS, the City Councl1 of the City of Arcadla has heretofore requested the City Planning Commlssion to conslder and to make re- commendations upon the conduct of foster homes In the Clty of Arcadia, particularly with reference to the zone In which foster homes should be permitted under Ordlnance No.760 of the Clty of Arcadla, and the condltlons, If any, whlch should be Imposed upon thelr conduct, and WHEREAS, pursuant to such request, the Arcadla City Planning Commission has Investigated the matter and at regular meetings has recelved testimony relative thereto, and WHEREAS, Section 15 of Ordinance No.76o provides that if any "Use" is for any reason omltted from the 11sts of those speclfled as permlsslble In each of the various zones, It shall be the duty of the Clty Plannlng Commisslon to ascertain all pertinent facts concerning sald use, and by resolution of record set forth its findings and reasons thereof, and such findings and resolutions shall be referren to the Clty Council and, If approved by the City Councl1, thereafter such Interpretatidn shall govern. WHEREAS, the Clty Planning Commission by Its Resolution No.73 made certaln flndings and recommendatlons concerning the conduct of Foster Homes In the City of Arcadla; NOW, THEREFORE, the City Councl1 of the Clty of Arcadla does hereby find, determine and resolve as follows: SECTION 1. That there Is need for the providing of foster care to many chlldren withln the Clty of Arcadia; that such need Is acute because of the condltlons o~ the times, the fact that many fathers are engaged in mllitary servlce, and that many mothers, for one reason or another, are obllged to work full or part time to provlde or augment family income. SECTION 2. That Ordinance No.760 of the City of Arcadla does not speciflcally.or generally define, nor does it speciflcally or -1- generally refer to the provlding of foster care in any zone In the City of Arcadla; that It Is necessELrY and advlsable that the provid- Ing of foster care be speclfically permltted and regulated in the City of Arcadia. SECTION 3. That the term "foster home" is hereby deflned as follows; dFoster home shall mean any home In which foster care of children under twelve (12) years of age, and not exceeding slx (6) In n~ber, including members of the faml1y of the operator who are under twelve (12) years of age, is, for monetary conslderatlon, provld- ad for less that twenty-four (24) hours a day under 11cense issued by the State of Callfornla DepELrtment of Social WelfELre." SECTION 4. That from and after the date hereof the conduct of a foster home, as herelnbefore defined, shall be included as a use permissible in Zones R-l, R-2, and R-3 upon the following condltlons: (a) That a permlt be requlred In each Instance under appllcable regulatory ordinances of the Clty of Arcadla. (b) That the owners of property within three hunnred (300) feat of any proposed foster home be glven written notice of a publlc hearlng to be held on the application of such permit. (c) That no permlt be granted except upon conditlon that a license be obtELined from the State of Callfornia for such home. (d) That such permit be for one (1) yeELr only and a renew- able concurrently wlth the State License. (e) For foster homes located in Zone R-l only, a permlt shall not be granted If the owners of more than one-third of the area within a radlus of 300 feet of the property upon whlch the foster home Is proposed to be conducted, object, or If the owner of the immedlately adjacent parcel on elther slde objects; provlded however, that the protests of such property owners shall be mandatory only with reference to the initial appllcatlon of an operator of a foster home at a given location. SECTION 5. The City Clerk shall certify to the adoption of this Resolutlon. I HEREBY CERTIFY that the foregoing Resolutlon was adopted at a regular meetlng of the Clty Council of the Clty of Arcadla hold on the tST day of July, 1952, by the affirmative vote of -~ at least three Councl1men, to-wlt: AYES: Councllmen Dov.
