HomeMy WebLinkAbout2263 RESOLUTION NO. 2263 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADT4, CALIFORNIA, SETTING A HEARING FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE PUBLIC CONVENI~NCE AND NECESSITY REQUIRE THE IMPROVEMENT OF A PORTION OF LAS TUNAS DRIVE AND OTHER STREETS, ALL WITHIN THE CITY OF ARCADIA. WHEREAS, Sectlon 17 of Article XIII of the Constitution of the State of Cs11fornia provides that the debt limitation and majority protest provisions of said section shall not apply if, after the glving of such reasonable notice by publlcation and posting and the holdlng of such publlc hearing as the City Council of the Clty of Arcadla shall have prescribed, said councl1 by no less than a four-fifths (4/5ths) vote of all members thereof, finds and determines that the public convenlence and necessity requlre tne improvement proposed to be made; end, WHEREAS, Section 2804 of the Streets and Highways Code of the State of California provides that the "Speclal Assessment In- vestlgation, Limltation and Majorlty Protest Act of 1931" shall not apply to any proceeding otherwise subject thereto when sald improve- ment proceeding Is by a charter city and sald city has complied wlth the provlslons of Section 17 of Article XIII of the Constltutlon of the State of Callfornia; and, WHEREAS, the City of Arcadia is a charter city of the State of Callfornia, NmI, TH~REFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That said City Council proposes to Initiate proceedings for the improvement of Las Tunas Drive between EI Monte Avenue and Live Oak Avenue, Florence Avenue between Woodruff Avenue and Palm Drive, and La Cadena Avenue between Duarte Road and Falrview Avenue, all withln the City of Arcadla, by the construc~ion of concrete gutter adjacent to concrete curbs where the same are in existence in condltion and location acceptable to the Cit~ and by the construction of concrete curb and gutter, where no such curb is In existence, on said portions of sald street~ and appurtenant work thereto. The -1- ,..o~1-~O nature, locatlon, and extent of the proposed improvement and the district to be assessed for the cost and expenses thereof are as shown respectively on the Profile and Improvement Plan Job No. 199 and specifications entltled "Specifications for the Improvement of a Portlon of Las Tunas Drive and Other Streets in the Clty of Arcadia", adopted and approved by said City Council by Resolution No. 2262 on the 1st day of July, 1952, and Assessment Dlstrlct Map No. W-bl, adopted and approved by said City Council by Resolution No. 2261 on the Is t day of July, 1952, and on file in the Office of the City Englneer and the Office of the Clty Clerk of said City, to which said plan and profile, assessment district map and speCifications, reference is made for all particulars relative thereto. SECTION 2. That the total estimated cost of the proposed Improvement is Eleven Thousand Three Hundred Eighty-elght & 52/100 Dollars (~1l,388.52). SECTI,ON 3. That the said improvement shall be conducted under the Improvement Act of 1911, which ls Divlslon 7 of the Streets and Hlghways Code of the State of Callfornia. SECTION 4. That notice is hereby given that on Tuesday, the 15th day of July, 1952, at 8:00 o'clock P.M. in the Council Chamber located In the City Hall, Arcadia, California, there shall be a publlc hearlng before said City Council for the purpose of determining whether the public convenlence and necessity require the above described Improvement. SECTION 5. That the City Clerk shall give notlce of the hearing by posting a copy of this resolution in the manner pre- scribed by Sectlon 5065 of the Streets and Highways Code and by publlcatlon as hereinafter provlded. Any person Interested may m~e protest agalnst the proposed improvement in wrltlng filed with the City Clerk at any time not later than the hour set for the hear- ing in the manner provided by Section 5220 of the Streets and Highways Code. -2- .- SECTION 6. That the Clty Clerk hereby is directed to pub11sh this Resolutlon in the Arcadia Bulletin on two successive dates, the flrst publicatlon to be made not less than ten (10) days prior to the date of the above public hearing. SECTION 7. The City Clerk shall certify to the adoption of thls resolution and thenceforth and thereafter the same shall be in full force and effect. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the ~ day of July , 1952, by the followlng vote: AYES: Councilmen Doy.
