A RESOLUTION OF THE CITY 'COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, SETTING A HEARING FOR THE
PURPOSE OF DETERmNIlm llHETHER THE PUBLIC CON-
VENIID~CE AND ~~CESSITY REQUIRE THE I~~OVID,1ENT
OF PORTIONS OF LAS TUNAS DRIVE) FLORE1WE AVENUE
AND LA CADENA AVENUE, ALL i'lITHIN THE CITY OF
ARCADIA.
\IHEREAS) Section 17 of Article XIII of the Constitution of
the State of California provides that the debt limitation and majority
protest provisions of said section shall not apply if, after the
giving of such reasonable notice by publication and posting and the
holding of such public hearing as the City Council of the City of
Arcadia shall have prescribed) said council by no less than a four-
fifths (4/5ths) vote of all members thereof) finds and determines
that the public convenience and necessity require the improvement
proposed to be made; and,
llHEREAS) Section 2804 of the Streets and Highways Code of
the State of California provides that the "Special Assessment In-
vestigation, Limitation and r,!aj'ority Protest Act of 1931" shall not
apply to any proceeding otherwise subject thereto when said improve-
ment proceeding ~s by a charter city and said city has complied with
the provisions of Section l7 of Article XIII of the Constitution of
the State of California; and,
WHEREAS) the City of Arcadia is a charter city of the
State of California)
NON, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
DOES RESOLVE AS FOLLOV1S:
SECTION 1. That said City Council proposes to initiate
proceedings for the improvement of Las Tunas Drive between El Monte
Avenue and Live Oak Avenue, Florence Avenue between Woodruff Avenue
and Palm Drive, and La Cadena Avenue between Duarte Road and Fairview
Avenue, all within the City of Arcadia, by the grading of portions of
said streets to be improved and by the construction of concrete curbs

and gutters and appurtenant work thereto. The nature, location and
extent of the proposed improvement and the district to be assessed
for the cost and expenses thereof are shown respectively on the
Profile and Improvement Plan Job No. 199, and Specifications entitled
"Specifications for the Improvement of a portion of Las Tunas Drive
and other Streets in the City of Arcadia," adopted and approved by
said City Council by Resolution No. 2274, on the 30th day of July,
1952, and Assessment District Map No. W-61, adopted and approved by
said City Council by Resolution No. 2261 on the 1st day of July, 1952,
and on file in the office of the City Engineer and the office of the
City Clerk of said City, to which said plan and profile, assessment
district map and specifications, reference is made for all particulars
relative thereto.
SECTION 2. That the total estimated cost of the proposed
improvement is Eleven Thousand Three Hundred Eighty-eight & 52/100
Dollars ($11,388.52).
SECTION 3. That the said improvement shall be conducted
under the Improvement Act of 1911, which is Division 7 of the Streets
and Highways Code of the State of California.
SECTION 4. That notice hereby is given that on Tuesday
the 19th day of August, 1952, at $:00 o'clock p.m. in the Council
Chamber located in the City Hall, Arcadia, California, there shall
be a public hearing before said City Council for the purpose of
determining whether the public convenience and necessity require
the above-described improvement.
SECTION 5. That the City Clerk shall give notice of the
hearing by posting a copy of this resolution in the manner prescribed
by Section 5065 of the Streets and Highways Code and by publication
as hereinafter provided. Any person interested may make protest
against the proposed improvement in writing filed with the City Clerk
at any time not later than the hour set for the hearing in the
manner provided by Section 5220 of the Streets and Highways Code.

SECTION 6. That the City Clerk hereby is directed to
publish this Resolution in the Arcadia Bulletin on two successive publica-
tions-, the first publication to be made not less than ten (10) days
prior to the date of the above public hearing.
, SECTION 7. The City Clerk shall certify to the adoption
of this resolution and thenceforth and thereafter the same shall
be in full force and effect.
