A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, SETTING A HEARING FOR THE
PURPOSE OF DETER~~NING :.~ETHER THE PUBLIC CON-
VENIENCE AND NECESSITY RE~UIRE THE HlPROVEr.;ENT
OF A PORTION OF THE FIRST ALLEY SOUTH OF LA
PORTE STREET AND OTHER ALLEYS, ALL ;iITHIN THE
CITY OF ARCADIA.
WHEREAS, Section 17 of Article XIII of the Constitution of
the State of California provides that the debt limitation and majority
protest provisions of said section shall not apply if, after the
giving of such reasonable notice by publication and posting and the
holding of such public hearing as the City Council of the City of
Arcadia shall have prescribed, said council by no less than a four-
fifths (4/5thsl vote of all members thereof, finds and determines
that the public convenience and necessity require the improvenlent
proposed to be made; and,
~rnEREAS, Section 2804 of the Streetsand Highways Code of
the State of California provides that the "Special Assessment Inves-
tigation, Limitation and Majority Protest Act of 1931" shall not
apply to any proceeding otherwise subject thereto when said improvement
proceeding is by a charter city and said city has complied with the
provisions of Section 17 of Article XIII of the Constitution of the
State of California; and,
\vHEREAS, the City of Arcadia is a charter city of the State
of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That said City Council proposes to initiate pro-
ceedings for the improvement of the first alley south of La Porte
Street from First Avenue to Second Avenue, a portion of the first alley
north of Colorado Boulevard from First Avenue to Lorena Avenue, a portion
of the alley east of Santa Anita Avenue from Forest Avenue to Floral
Avenue, a portion of the first alley north of Forest Avenue from North

View Avenu~ to Second Avenue, a portion. of the alley south of Diamond
Street from Santa Anita Avenue to First Avenue, a portio~ of the alley
south of El Dorado Street from Santa Anita Avenue to First Avenue a

portion of the alley south of Fano Street from Santa Anita Avenue to
Second Avenue, a portion of the alley south of Fano Street from First
Avenue to Second Avenue, all in the City of Arcadia, by the grading,
preparing subgrade paving, and pavement of concrete gutters and aprons
on said portions of said alleys and appurtenant work thereto, the
nature, location and extent of the proposed improvement and the district
to be assessed for the cost and expenses thereof are shovm respectively
on the profile and improvement plan job No. 200, and specifications,
entitled "Specifications for the Improvement of a Portion of the First
Alley South of La Porte Street and Other Alleys in the City of Arcadia,"
adoptedmd approved by said City Council by Resolution No. 2280 on
the 30th day of July, 1952, and assessment district map No. ;'1-62
adopted and approved by said City Council by Resolution No. 2279 on
the 30th day of July, 1952, and on file in the office of the City
Engineer and the office of the City Clerk of said City, to which said
plan and profile, assessment district map and specifications reference
is made for all particulars relative thereto.
SECTION 2. That the total estimated cost of the proposed
improvement is Twenty Seven Thousand Nine Hundred Twenty Six Dollars
and Eighty Cents (~27,926.80).
SECTION 3. That the said improvement shall be conducted
under the Improvement Act of 1911, which is Division 7 of the Streets
and Highways Code of the State of California.
SECTION 4. That notice hereby is given that on Tuesday the
19th day of August, 1952, at 8:00 o'clock p.m. in the Council Chamber
located in the City Hall, Arcadia, California, there shall be a public
hearing before said City Council for the purpose of determining

whether the public convenience and necessity require the above-
described improvement.
SECTION 5. That the City Clerk shall give notice of the
hearing by posting a copy of this resolution in the manner prescribed
by Section 5065 of the Streets and Highways Code and by publication
as hereinafter provided. Any person interested may make protest
against the proposed improvement in writing filed with the City Clerk
at any time not later than the hour set for the hearing in the manner
provided by Section 5220 of the Streets and Highways Code.
SECTION 6. That the City Clerk hereby is directed to
publish this Resolution in the Arcadia Bulletin on two successive publica-
tions" the first publication to be made not less than ten (10) days
prior to the date of the above public hearing.
SECTION 7. The City Clerk shall certify to the adoption
of this resolution and thenceforth and thereafter the same shall be
in full force and effect.
I HEREBY CERTIFY that the foregoing resolution was adopted
