HomeMy WebLinkAbout2286 RESOLUTION NO. 22S6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF PORTIONS OF LAS TUNAS DRIVE, FLORENCE AVENUE AND LA OADENA AVENUE BY GRADING AND THE CONSTRUC- TION OF CONCRETE CURBS AND GUTTERS. WHEREAS, a public hearing has been held duly and regularly, pursuant to Resolution No. 2275 and the laws and Constitution of the State of California on the proposed improvement of Las Tunas Drive between El Monte Avenue and Live Oak Avenue, Florence Avenue between Woodruff Avenue and Palm Drive and La Cadena Avenue between Duarte Road and Fairview Avenue, all within the City of Arcadia, by the grading of portions of said streets and by the construction of concrete curbs and gutters and other work appurtenant thereto; and WHEREAS, said improvement has been considered fully: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the said City Council hereby finds and determines that the public convenience and necessity require the improvement of Las Tunas Drive between El Monte Avenue and Live Oak Avenue, Florence Avenue between Woodruff: Avenue and Palm Drive and La Cadena Avenue between Duarte Road and Fairview Avenue, All within the City of Arcadia, by the grading of portions of said streets and by the construction of concrete curbs and gutters and other work appurtenant thereto, as shown on Profile and Improvement Plan, Job No. 199, and specifications entitled "Specifications for the Improvement of a Portion of Las Tunas Drive and Other Streets in the City of Arcadia. SECTION 2. That the said City Council hereby finds and determines further that the "Special Assessment Investigation, - I - ~~ Limitation and Majority Protest Act of 1931" shall not apply to the making of said improvement. SECTION 3. That the said improvement shall be conducted under the Improvement Act of 1911 which is Division 7 of the Streets and Highways Code of the State of California, and the City Engineer and the City Attorney hereby are instructed to present to the said City Council the said Resolution of Intention required by said Improve- ment Act to initiate the proceedings for said improvement. SECTION 4. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
