That the public interest and convenience require and that it is the intention of the City Council of the City of Arcadia to form a lighting maintenance district to be known as Lighting !.iaintenance District Ho. 4, for the purpose of assessing said district to pay a portion of the cost and expenses of maintaining and operating a street lighting system consisting of fourteen (14) steel poles, equipped with a mast arm and an enclosed type luminaire, connected with a single overhead conductor. Each luminaire will contain one 2500 lumen street series lamp, and will burn on an all-night basis. SECTION 2. The items of, expense of maintenance and operation of the said lighting system to be furnished and to be assessed in part against the lands within the district, (exclusive of improvements), are electric power, repairs, replacements, labor, materials, engineering, printing and advertising. The estimated amount of electric power necessary for said system for each year'is seven thousand, seven hundred and sixty-two (7,762) Kilowatt hours and the estimated cost of said electric power for the first year bf maintenance and operation is the sum of one hundred and thirty-one dollars and four cents (~131.04) and that the estimated cost of all other items of maintenance and operation of said system for the first year is the sum of four hundred and forty-nine dollars and seven cents ($449.07). SECTION 3. That the said contemplated maintenance and . - ~:'i' ".; operation of said lighting system in the opinion of the City Council of the City of Arcadia is of more than local or ordinary public benefit and said City Council hereby makes the expense of said maintenance and operation, exclusive of the amount to be paid by said City as stated in Section 5 hereof, chargeable upon a district, which district said City Council hereby declares to be the district benefited by said maintenance and operation and to be assessed to pay the cost and expenses thereof; which district shall include all the lots in Tract 15285. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed district was approved and adopted by Resolution No. 2205 of the City Council of said City of ~cadia, and is "on file in the office of the City Clerk of the City of Arcadia; Reference is hereby made to said plat or map for further, full anq complete description of said Lighting I,;aintenance District No.4 and said map so on file shall govern for all details as to the extent of such district. SECTION 4. That said maintenance and operation shall be furnished for said system for a period of five years from the date of the formation of said district. SECTION 5. The City Council of the City of Arcadia hereby orders that fifty percent (50%) of the total maintenance and operation cost and expenses of said system be paid out of the treasury of said City from the general fund of said City. SECTION 6. Notice is hereby given that on Tuesda~ the 15th day of January , 195~, at the hour of 8:00 0' clock P. M. of said day, in the Council Chambers of said C~ty Council of said City of Arcadia, in the City Hall of said City, any and all , persons owning land or having any interest in lands within the district liable to be assessed for the expenses of said maintenance and operation of any portion thereof, may be heard and any of said persons may present any objections that they may have by protest. -2.;. SECTION 7. All the proceedings for the aforesaid main- tenance and operation of said system shall be had and tal,en under and in accordance vith the provisions of an act of the Legislature of the State of Cal~fornia known ,and designated as the Municipal Lighting maintenance District Act of 1927, being Division 14, Part 3 of the Streets and Highways Code of the State of California. SEC'l'lON 8. The Superintendent of Streets 'shall post or cause to be posted, copies of this resolution headed "Notice of '", Formation of Lighting j-,iaintenance District" along all open streets ,4a...t-i within siad district liable to be assessed, in the manner and form required by laW. The City' Clerk shall cause this Resolution to be published twice, the first publication to be at least twenty (20) days before the date of the hearing set forth. SECTION 9.
