RESOLUTION NO.2208
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARCADIA~ CALIFORNIA, APPROVING, ADOPTING
AND ACCEPTING THE FINDINGS, AND RECOMMENDATIONS
OF THE PLANNING COMMISSION OF SAID CITY AND
DENYING THE APPLICATION FOR A VARIANCE AFFECTING
CERTAIN REAL PROPERTY IN SAID CITY.
YrdEREAS, November 6, 1951, there was filed with the Planning
Commission of the City of Arcadia the petition of Adolph B. Eichele,
as owner, requesting a zone variance affecting the following des-
cribed property in the City of Arcadia, to wit:
The West 45.19 feet of Lot 29 and the East 50 feet
of Lot 30~ Tract No.3430, as shown on map recorded
in Book 42, Page 32 of Meps~ records of Los Angeles
County~ and located at 540 Fairview Avenue,

To permit the construction of a fourth single family dwell-
ing upon said property presently zoned R-lj
WHEREAS, after notice required by Ordinance No.760 of said
City a public hearing on this matter was duly held before the Plan-
ning Commission of the City of Arcadia on November 27, 1951, at
which time all interested persons were given an opportunity to be
heard and to present evidence; and
WHEREAS, in the opinion of said Planning Commission there
are no exceptional or extraordinary circumstances or conditions
applicable to the property involved, or to the intended use of
the property, that do not, apply generally to the property or class
of uses in the same vicinity or zone, except that applicant has
in the course of completion, a fourth single family residence
thereon, under a purported building permit issued contrary to
Ordinance No.760; and the granting of the variance requested is not,
necessary for the preservation or enjoyment of any substantial
property right of the applicant possessed by other property in the
same vicinity and zone as the property is already as fully develop-
ed as Ordinance No.760 presently permits, and applicant has acquir-
ed no additional property right entitling him to any variance by
reason of any permit issued contrary to the provisions of local
law; that the fact that applicant has in the course of completion

a fourth slnglefamily residence thereon under a purported
building permit issued contrary to Ordinance No.760, does not,
in the opinion of said Commission, constitute such an exceptional
or extraordinary circumstance as to require the granting of the
variance requested.
WHEREAS, the Planning Commission of the City of Arcadia
has recommended in its Resolution No.55, passed, approved and
adopted December 4, 1951, that the aforesaid petition be denied for
the reaSOns more fully set forth therein.
NOW, THEREFORE, the City Council of the City of Arcadia
does find, determine and resolve as follows:
SECTION 1. That the findings of the City Planning Com-
mission as set forth in their said Resolution NO.55 be and each of
the same are hereby adopted and made the findings of the City
Council the same as if herein again specifically set forth in full;
SECTION 2. That the recommendation of the City Planning
Commission, as set forthin its said Resolution No.55, be and the
same is hereby approved in full, and that the request of the
petitioner for a zone variance as heretofore described, be and the
same is hereby denied.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 2nd day of January, 1952, by the affirmative vote of at
least three Councilmen, to-wit:
