HomeMy WebLinkAbout2227 RESOLUTION NO.2227 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS LEGISLATIVE INTENT. WHEREAS, toe City Council of the City of Arcadia, did on August 7, 1951, adopt Ordinance No.831 entitled: "An Ordinance of tbeCity Council of the City of Arcadia Amending ~ection 8 of Ordin- ance No.726 of said City.", which Ordinance, among other things re- gulated the distance from Which animals including horses, must be kept from buildings occupied by human beings, which prOVisions were more restrictive than those heretofore in effect in said City of Arcadia; and WHEREAs, because hardships unforseen at tbe time of the adoption of said Ordinance No.831, Ord1n8nce No.837 entitled: "An Ordinance of .., the City Council of the City of Arcadia, California, Amending Section 8 (c) of Ordinance No.726 of Said City. ", was adopted by this Council on December 4, 1952, as an urgency measure, which Ordinance exempted preexisting uses from the restrictions imposed by Ordinance No.831; NOW, THEREFORE, the City Council of the City of Arcadia does hereby determine and resolve as follows: SECTION 1. That in the adoption of said Ordinance No.837, this Council intended to eliminate the hardships resulting from the application of the provisions of said Ordinance No.831 to conditions existing at the time of the adoption of said Ordinance No.831, and to prevent inequities which would otherwise result from the appli- cation of said Ordinance No.831 and unforseen at the time of its adoption. That this Council hereby declares that in the adoption of said Ordinance No.837 it was the intent'of this Council that said Ordinance No.837 be interpreted and be given the effect of modifying said Ordinance No.831 as of the date of the adoption of said Ordinance No.831, the same as it OrdinancesNo.831 and 837 had been adopted simultaneously, so that Ordinance No.837 shall be applicable to and enforced in the light of colidi tions in existence at the time of the adoption of Ordinance No .83}. SECTION 2. The City Clerk shall certify to the adoption of this -1- Resolution.
