THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HBREBY PI~m, D"::TIffii,;INZ aHD R.t:.SOI,VE AS FOLL0\7S: S~CTION 1. That the public interest and convenience require and that it is the intention of the city Council of the City of Arcadia to form a liBhting maintenance district to be knO\7n as Lighting IJaintenance District NO.3, for the purpose of assessing said district to pay a por- tion of the cost and expenses of maintaining and operating a street lighting system consisting of fourteen (14) steel poles p.nd one (1) uooden pole, equipped ~ith a mast arm and an enclosed type lumina ire , connected \~th a single overhead conductor. Each luminaire will con- tain one 2500 lumell street series lamp and will burn on an all night basis. SECTION 2. The items of expense of maintenanco and operation of said liGhtinG syst~m to be furnished and to bo assessed in part against the lands ~Lthin the district, (exclusive of improvements), ere electric po~er, repairs, replacementc, labor, materials, engineering, printing and advertising. The estimated amount of electric pouer necessary for said system for each year is eight thousand three hundred and sisteen (8316) kilowatt hours and the estimated cost of said electric povrer for 'the firut yeaI' of maintenance and operation is the sum of (;>140.40 The estimated cost of all other items of maintenance and opera- tion of said system for the first year is the sum of 0439.71. SJ,;CTION 3. That the said contemplated maintenance and operation of said li[;htinb SY(ltem in the opihion of the City Council of the City of Arcadia is of more than local or ordinary public benefit and said City Council hereby makes the expense of said maintenance and operation, exclusive of the amount to be paid by said City as stated in Section 5 hereOf, chargable upon a district, which district said City Council hereby declares to be the district benefited by said maintenance and operation and to be assessed to pay the cost and expenses thereof; which district shall include all the lots in Tract 16920 and all the lots in Tract 15073; lots 80, 81 and 82 in Tract 15285; part of lot 7, block 95 and part of lot 6, block 94 in Santa Anita Tract. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed district pas approved and adopted by Resolution No. 2143 of the City Oouncil of said City of Arcadia, and is on file in the office of the City Clerk of the City of Arcadia. Reference is hereby made to said plat or map for further, full and complete description of said Lighting Maintenance District ~o. 3, an~ said map SO on file shall govern for all details as to the extent of' such dis tric t. SEC~ION 4. That said maintenance and operation shall be furnished for said system for a period of five years from the date of the formation of said district. SECTION 5. The City Council of the City of Arcadia hereby orders that fifty (50%) per cent of the total maintenance and operation cost and expenses of said system be paid out of the treasury of said City from the general fund of said City. SECTION 6. Notice is hereby given that on Tuesday, the 17th day of July, 1951, at the hour of 8:00 O'clock, P.i,;. of said day, in the Council Chambers of said City Council of said City of Arcadia, in the City Hall of said City, any and all persons o~ning land or having any interest in landa uithin the district liable to be assessed for the expenses of said maintenance and operation or any portion thereof, may be heard and any of said persons may present any objections that they may have by protest. SECTION 7. All the proceedings for the aforesaid maintenance and operation of said system shall be had and taken under and in accordance uith the provisions of an act of. the Legislature of the State of California knonn and designated as the ;,;unicipal Lighting Maintenance Di,'3trict Act of 1927, being Division 14, Part 3 of the streets and HighvaY3 Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this resolution headed "Notice of formation of lighting maintenance district" along all open streets within said district liable to be assessed, in the manner and form required by law. The City Clerk shall cause this resolution to be published twice; the first pUblication to be at least twenty (20) days before the date of the hearing set forth. SECTION 9.
