HomeMy WebLinkAbout2160 RESOLUTION NO.2160 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE FORMA.TION OF A LIGHTING MAINTENANCE DISTRICT, DESIGNATED AS "LIGHTING MAINTENANCE DISTRICT NO.3", TO PAY THE COST AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF FIRST AVENUE, VIRGINIA DRIVE, ELEVADO AVENUE AND GRANDVIEW AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES DETERl'iIINE, ORDER, FIND AND RESOLVE AS FOLLOvlS: SECTION 1. That pursuant to the prOVisions of Resolution of Intention No.2144 passed, approved and adopted June 5, 1951, and after a public, hearing on the matter in conformity with the pro- visions or the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3 of the Streets and Highways Code of the State of California, it is hereby ordered that a light- ing Maintenance District be and the same is hereby formed, and that the boundaries of such Lighting Maintenance District, which District is to pay the cost and expenses for the maintenance and operation of a street lighting system now installed on portions of First Avenue, Virginia Drive, Elevado Avenue and Grandview Avenue over and above the 50% of the total maintenance and oper- ation cost and expenses thereof to be paid out of the Treasury of the City of.Arcadia from the General Fund of said City,shall be and the same are hereby finally established in conformance with and as shQwn on that certain map entitled: "Diagram of Light- ing Maintenance District No.3 heretofore prepared by the City Engineer and approved and adopted by Resolution No.2l43 of the City council of, the City of Arcadia on June 5, 1951, and on file in the office of the City Clerk of said City. SECTION 2. That the items of maintenance and operation of the aforesaid street lighting system agreed to be furnished and the estimated cost for the first year, are as follows: electric power, repairs,.replacements, labor, materials, engineering, print- ing and advertising) the estimated amount of electric power nec- essary for said., system for each year is 8316 Kilowatt hours, and the estimated cost of said electric power for the first year is -1- \'i\'lJrJO the sum of ONE HUNDRED FORTY AND 40/100 ($140.40) DOLLARS; that the estimated cost of all other items of maintenance and oper- ., ation for th~ first year is the sum of FOUR HUNDRED THIRTY NINE AND 71/100 ($439.71) DOLLARS; that the items hereinabove enumer- ated shall b~; furnished from time to time as necessary. SECTION ~. That the percentage of the total expenses of the aforesaid,maintenance and operation to be paid by the afore- said District, as set forth in aforesaid Resolution No.2144 of the City Council of the City of Arcadia, shall be paid by special assess~ent taxes levied upon all lands, exclusive of improvements, within said district, as hereinable formed and established. SECTION 4. That Fifty Percent (50%) of the total expenses of maintenance and operation in said District shall oe paid by such District, and Fifty Percent (50%) thereof shall be paid out of the Treasury of the City of Arcadia from the General Fund of said City. SECTION 5. That a certified copy of this Resolution shall be filed with the Assessor who makes the assessment for general City taxes, and thereafter the Assessor in making up the City assessment roll shall segregate the property included within the District, hereby ordered formed, on the assessment roll under the district designation contained in the Resolution, to wit: "Lighting Maintenance District No.3." SECTION 6. The City tlerk'shall certify to the adoption of this Resolution.
