RESOLUTION NO.2171
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING "AND GRANTING A ZONE
VARIANCE AFFECTING CERTAIN REAL PROPERTY IN SAID
CITY TO PERMIT THE MAINTElf.ANCE .AND OPERATI ON OF A
NON-PROFIT DAY NURSERY SCHOOL THEREON UPON SPECIFI-
ED CONDITIONS.
VHEREAS, pursuant to the prOVisions of Ordinance No.
760 of the City of Arcadia, adopted May 3, 1949, as amended,
the Planning Commission of said City bas considered the verifi-
ed application of Arcadia Non-Profit Nursery Scbool, as owner,
for a zone variance on the folloving described property in the
City of Arcadia, to-vit:
The South 57.5 feet of the North 147.5 feet of Lot 90,
Tract No.808, as shown on map recorded 1n Book 16,
Pages 82 and 83 of Maps, recordsof Los Angeles County,
and knovn as 1511 South Tenth Avenue,
to permit the maintenance and operation of a non-profit Day
Nursery SCbool thereon and thereat, five days a veek from 9:00
A.M. to 11:30 A.M. annually from September through June, and for
the conduct thereat of parent meetings each Monday from 8:00 P.M.
to 10:00 P.!4.:, and
WHEREAS, tbe C1ty Planning Commission, after consider-
ation of sueh applieation, and acting in an advisory capaeity
to the C 1 ty Council, has made 1 ts findings and recommenda t10ns
tbereon under its certa1n Resolution No.50 entitled: "A Resolution
of the City Planning Commission of the City of Arcadia, California,
Recommending the granting of a Zone Variance Affecting Certain
Real Property Located in said City to Fermit the Maintenance and
Opera tion of a Non-Profi t Nursery School Tbereon.", a true copy
of vhich is attacbed hereto add made a part hereof by reference
tbe same as if herein fully set forthJ
NOW, THEREFORE, the City Council doeshereby find, de-
termine and resolve as follovs:
SECTION 1. That tbere vere no protests, orally or vritten,
against said application, before said Commission or before the
City Council.
SECTION 2. That the rear of applicant's said property

abuts upon a wash; that the existing structure on said premises
is well suited for the purposes for which the applic~tion has
made, and is ill- designed for residential use; that a dance studio
is, and for some time has been, conducted in the near vicinity of
said property; that these circumstances are unusual and do not
apply general~y to property in the same zone.
SECTION 3. That the granting of the variance requested will
not be inconsistent with good planning practice or the provisions
of the master zoning plan, or with the present development of the
neighborhood in which said property is located, nor will the
granting of the variance upon the conditions herein imposed ad-
versely affect.' the comprehensive general plan.
SECTION 4. That such variance is necessary for the preser-
vation and enjoyment of substantial property rights of the appli-
cant.
SECTION 5. That the granting of the variance requested will
not be materially detrimental to the public welfare or injurious
to the property or improvements in such vicinity and zone in which
the property is located, but will be beneficial to the area affected.
SECTION 6. That the petition of Arcadia Non-Profit Day
Nursery School to use the property hereinabove described for the
purposes and at the times described in said application be and the
same is hereby granted upon the following conditions:
(a) That the activities of said nursery school be limited
to the hours, times and purposes specified in aforesaid application.
(b) That no deliberate violation of any City, County or
State I~W applicable to Arcadia Non-Profit Nursery School be per-
mitted by said ~pplicant, its officers and agents.
(c) That said variance be limited to the period of fifteen
calendar years from and after the date hereof,s~id variance to be
renewable by the City Council upon written application to it without
necessity of public hearing by or before said City Planning Com-
mission or the City Council.

(d) That each condition herein specified be interdepen-
dent each upon the other and the violation of any of said con-
di tions shall be grounds for the cancellation of the variance
hereby granted.
(e) That insofar as the findings or recommendations of
the City Planning Commission contained in their aforesaid Re-
solution NO.50 are inconsistent or in conflict with any portion
hereof, the same are to tbat extent hereby disapproved and over-
ruled.
SECTION, 7. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 21st day of August, 1951, by the affirmative vote of
at least three CounCilmen, to-Wit:
AYES: Councilmen Kennett, Nottingbam, Scbmocker and Sullivan
NOES: None
ABSENT: Councilman Klomp
