C'urry and Doroth;, Nell CurrJ' as plaintiff'S ar;ainst the ('ity of Arcadia end against the rla;,'or and C'it;, Council of said Cit~ in their respective capacities as such, said gO~- plaint bearing File No.13~13-C; and WHEREAS, the defendants named in se,id complain t alread~" have been or sonn ,-rill be s€rv~d with copies of' sununons issued in said action, oecause of ~hich it is ne~essar;, that special cOillu:el be retained by the Ci t;," of Arcadia for the purpose 01' advisine; sa.td City and the officers thereof relative to the said action, and for the purpose of preparing and filing the pleadin[;s required therein, and for the purpose of defending against said action; and ~REt..S, services of such a nature are not ombraced with- in the terms of employment of the City ~ttorney; NOW, THEREFORE, the City Council of the City of Arcadic does find,deteroine llnd resolve af; follous: SEOTION 1. That it is to the best intorests of the C'ltr of Arcadia,. end the inhabi te,nts thoreof, that opecial counsel be employe~ for the purpose of advising said City and the officers thereof' relative to the aforesaid action heretofore filed against it and tt.em, and for the purpose of preparin[; and filinc; all pleadinGS and documents and for the purpose of doinp all thinLs deemed b~- such counsel necessar;r or advisable in the defense of said action. SECT10N 2. That ~essrs. Burke, Williams and Burke and Lasher n. Gallagher be and they are hereby employed as speclal counsel fo~ the purpose of adVisinG said City and the officers thereof' relative to the said action, and 1'or the purpose of pre- -1- i-"" \~,,'i parin& and filins such pleadings end documents as are neceesary or advisable in said action, and for the purpose of defending said action Oh behalf of the City and the named defendants in their official capacities. SECTION 3. Th~t the City of Arcadie pay to said special counsel thus ,appointed, in compensation for their services to oe thus rendered, the fair and reasonable value of such services; that said special counsel shall, from time to time, submit an itemized account of the costs incurred in said action, and a statement of the sum requested for the services rendered pursuant hereto; that:the costs incurred shall, upon approval of the items, be forthwith paid. SECTION 4. That the City Council shall determine the reasonablenees of the sum requested as compensation for the ser- vices rendered by the special counsel thus appointed, and in such determination the City rouncil shall be the sole and exclusive judges and their determinRtion in this regard shall be final. Up- on such determination, the City shall pay to the special counsel thus appointed, in compensation for his, or their, services thus rendered, the fair and reasonable value of such services as thus determined by the City Council. SECTION 5. The 6ity Clerk shall certify to the adoption of this resolution.
