HomeMy WebLinkAbout2083 RESOLUTION NO. 2083 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING CERTAIN WORK AND IMPROVEMENT TO BE DONE ON THE FIRST ALLEY SOUTH OF ALTA STREET, AND OTHER ALLEYS, IN SAID CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY, OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and Clltnvenience require that certain work and improvement be done in the City of Arcadia, to wit: the construction of concrete gutters, asphaltic concrete pavement, and other work, and the City Council of the City of Arcadia hereby orders the same' to be done, in accordance with Specifications and Improvement Pl,an No. C-50-2, on file in the office of the City Engineer of said City of Arcadia, adopted for said work, and under direction and to the satisfaction of Street Superintendent of the said City of Arcadia; that Resolution of Intention No. 2071 heretofore adopted by this Council on the 19th day of September, 1950, contains a complete description of the work and improvement to be done pursuant to, this Resolution, and refer- I en~ is hereby made to said Resolution of Intention No. 2071 for a complete description of the said work ~d improvement, and of the alleys or portions of such alleys in which said work and improve- ment shall be done. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution is shown on Profile and Improvement Plan No. C-50-2 on file in the office of the City Engineer of the City, to which I, Profile reference is hereby made for the description of such grade. SECTION 3. All of the foreg~ing work shall be done in accordance with said Profile and Improvement Plan No. C-50-2 on file in the office of the City Engineer of said City of Arcadia. - 1 - .,;.,,0 \,"-0 All work on grading and the construction of concrete gutters, asphaltic concrete pavement and other work shall be in accordance with the following specifications on file in the office of the City Engineer of said City of Arcadia, to wit: "Specifications for the improvement of the first alley south of Alta Street and other alleys in the City of Arcadia." Said Profile and Improvement Plan No. C-50-2 and the speoi- fications hereinabove referred to were" adopted by Resolution No. 2069 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are "hereby referred to for a more particular description of said work. All streets, avenues and alleys referred to in this Resolution are public streets, avenues and alleys of said City. SECTION 3-A. Said City Council hereby determines and orders that Five Thousand One Hundred and Seventy ($5,170.00) Dollars, representing a portion of the cost and expense of the con- struction above specified shall be paid out of the General Fund. SECTION 4.. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement, (except that portion of the cost of construction to be paid by the City of Arcadia as specified in Section 3-A herein), chargeable upon the District, which District said City Council hereby declares to be the District bene- , fited by said work and improvement and to be assessed to pay the i' costs and expenses thereof. A plat or map of said District indicating by a boundary line the extent of the lands included in said district was approved and adopted by Resolution No. 2070 of the City of Arcadia on the 19th day of September, 1950, and is on file in the offioe of the Ci ty Engineer of the City of Arcadia; reference is hereby made to said plat or map for a further, full, and complete - 2 - description of said Assessment District', which said plat or map is designated as Assesffinent District No. W-59, and said map so on file shall govern for all details as to the extent of such assessment district. SECTION 5. Said City Council also determines and declares that Serial Bonds Shall be issued to represent each assessment of Twenty five ($25.00) Dollars or more, remaining unpaid for thirty (30) days after the date of the recording of the Warrant to represent the expenses of said work and improvements. Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th, following their date and an even annual prop6rtion of the prIncipal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th, after their date,'! until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July, respectively, of each year after their date at the rate of six per cent (6%) per annum of all sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION b. All proceedings fo~ the aforesaid work and im- provement and for the issuance of said bonds shall be had and taken under and in accordance with the provisions of an Act of the Legis- lature of the State of California, known!and designated'as the "Improvement Act of 1911", being Division 7, Streets and Highways Code of the State of California. SECTION 7. The Arcadia Bulletin, a weekly newspaper of general circulation, published and circulated in said City of Arcadia, is hereby designated as the newspaper in which notice of said work and improvement inviting sealed proposals, shall be published in the - 3 - \ , manner and form and by the persons required by law. SECTION 8. The City Clerk of said City of Arcadia is hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together with the specifications therefor', inviting sealed proposals or bids for doing said work and said City Cler~ is also directed to publish twice in said news- paper designated as aforesaid, in the manner and form required by law, a notice inviting sealed proposal~ or bids for doing said work, and referring to the specifications posted or on file. Said notice shall require a certified check or bond, either, as presoribed by I law for an amount not less than ten per cent of the aggregate of the proposal. " Said sealed proposals or bids shall be delivered to the City Clerk of said City of Arcadia on or before eight o'clock P.M. on November 8, 1950; bids will be opened on said day and hour. SECTION 9. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, " held on the 17th day of October, 1950, by the affirmative vote of at least three Councilmen, to wit: AYES: Councllmen Kennett, Klomp, Nottingham, Schmocker and Sulli van NOES: None .
