A RESOLUTION OF THE CITY COm~CIL OF THE CITY OF ARCADIA, CALIFORNIA, A WARDING CONTRACT FOR CERTAIN WORK AND IMPROVE~ffiNT ON PORTIONS OF ESTRELLA AVENUE, IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. WHEREAS, the City Council of the City of Arcadia, did in open session at its regular meeting on April 4, 1950, publicly open, examine and declare all sealed proposals or bids for doing certain work and improvement on certain por- tions of Estrella Avenue, from Baldwin Avenue to El Sereno Drive, in said City; that Resolution of Intention No. 1984, heretofore adopted ,by this Council on the 7th day of February, 1950, contains a complete description of said work and improvement and reference is hereby made to said Resolution of Intention No. 1984 for a complete description of said work and improvement. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution, is shown on Profile and Improvement Plan No. C-186, on file in the office of the City Engineer of said City, to which profile reference is hereby made for the description of such grade. SECTION 3. That all of the foregoing work and improve- ment shall be done in accordance with s aid Profile and Improvement Plan No. C-186 on file in the office of the City Engineer of said City of Arcadia. That all the foregoing work and improvement, to wit: the construction of concrete curbs and gMtters and oil macadam pavement on portions of Estrella Avenue, as aforesaid, shall be in accordance with t he following specifications on file in the office of the City Engineer of the City of Arcadia, to wit: "Stan- dard Specifications No.9 for the construction of curbs, sidewalks, 1. INDEXED ~ /' gutters, oil macadamand concrete pavement." Said Profile and Improvement Plan No. C-186 ;;' and 1/ I the specifications hereinabove referred to were adopted by Reso- lution No. 1982 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more particular description of said work. All avenues and drives referred to in this Resolution are public ave- nues and drives of s aid City. SECTION 4. That said contemplated work and improvement, in t he opinion of the City Council of the City of Arcadia, is of more than local or ordinary pUblic benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, which district said City Council hereby declares to be the district benefitted by s aid work and improvement and to be assessed to pay the costs and expenses ,thereOf, which said District shall include all those lots in the said City of Arcadia, County of Los Angeles, State of California shown and indicated on the plat or map of said District, whereon is indicated by a boundary line the extent of the lands included in t he proposed assessment District, vhich plat or map w as approved and adopted by Resolution No. 1983, of the City Council of said City of Arcadia, and is on file in the office of the City Engineer of the City of Arcadia. Reference is hereby made to said plat or map for further, full and complete description of said a ssessment district, which said plat or map is designated as Assessment District No. W-58, and said map so on file shall govern all details as to the extent of such assessment district. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty-five Dollars ($25.00) or more, remaining unpaid for thirty (30) days after the date of the warrant, to represent the expenses of said work and improvement. Said Serial Bonds shall extend over 2. period of nine (9) years from the second day of January next ~uc- ODding the ne~t October 15th following their date and an even, annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July, respectively, of each year after their date, at the rate of six per cent (6%) per annum on all sums unpaid, until the whole of said principal and interest are paid. Said bonds and interest thereon shall be payable at the office of the City Treasurer of the taken under and in accordance with the provisions of an act of the Legislature of:the State of California, known and designated as the "Improvement Act of 1911", being Division 7, Streets and High- ways Code of the State of California. Reference is hereby made to Resolution No. 2001 of said City Council, declaring its intention to order said work to be done, for further particulars, which Resolution is on file in the office of the City Clerk of said City of Arcadia. NOW, THEREFORE, BE IT RESOLVED: SECTION 7: That the said City Council hereby rejects all of said proposals or bids, except the next herein mentioned, and hereby awards the contract for doing said work and improvement to the lowest, regular, responsible bidder therefor, to wit, to VI DO !'<OV I9CGVCt-l eJ:J{y)~'1 at the price mentioned in his proposal, on file for said work and improvement. SECTION 8: The City Clerk is hereby directed to publish notice of this award twice in tne Arcadia Bulletin, a newspaper of 3. general circulation, published and circulated in the City of Arcadia, and hereby designated for that purpose by said City Council. SECTION 9: The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopt- ed at a regular meeting of the City Council of the City of Arcadia, held on the 4th day of April, 1950, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Boucher, Klomp, Nugent, Russell and Sullivan NOES: None ABSENT: None ~~L ' City Clerk of the City ~ia.
