HomeMy WebLinkAbout1801 RESDLUTION NO. 1801 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AWARDING CONTRACT FOR CERTAIN WORK AND IMPROVEMENT ON A PORTION OF CALIFORNIA STREET IN S AID CITY OF ARCADIA. THE CITY COUNCIL OF T HE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. WHEREAS, the City Council of the City of Arcadia did in open session at its regular meeting on August 17, 1948, publicly open, examine and declare all sealed proposals or bids for doing cer- tain work and improvement on a portion of California Street in the City of Arcadia; that Resolution of Intention No. 1788 heretofore adopted by this Council on the 6th day of July, 1948, contains a complete des- cription 0 f said street work and improvement and reference is hereby made to s aid Resolution of Intention No. 1788 for a complete description of said work and improvement. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution, is shown on Profile and Improvement Plan No. C-173 on file in the office of the City ~ngineer of said City to which Profile refer- ence is hereby made for the description of such grade. SECTION 3. All the foregoing work shall be done in accord- ance with said Profile and Improvement Plan No; C-173 on file in the office of the City Engineer of said City of Arcadia. All work on grading and the construction of concrete curbs, gutters, gutters and sidewalks shall be in accordance with the following Specifications on file in the office of the City Clerk of said City of Arcadia, to-wit: "Stanqard Specifications No. 0 for the construction of curbs, sidewalks, gutters, oil macadam pavement and concrete pavement" All work on the construction of street pavement shall be in accordance with the following specifications on file in the 0 ffice of the City Clerk of said City of Arcadia, towit: "Standard Specifications No.3 for the construction of 2-1/4'" oil macadam pavement and re- surfaCing. n said Profile and Improvement Plan No. C-173 and the Speci- fications hereinabove referred to were adopted by Resolution No.1786 - 1- INDSXEO of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more particular description of said work. All streets and avenues referred to in this Resolution are public streets and avenues of said City of Arcadia. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of said City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby maffi s the expense of said work and improvement chargeable upon the District benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which s aid District is completely described in Resolution of Intention No. 1788, heretofore adopted by this Council on the 6th day of July, 1948, and to which Resolution re- ference is hereby made for a complete description 0 l' said District to be assessed to pay the cost and expense of said work and improvement. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assess~ent of Twenty-Five ($25.00) Dollars, or more, remaining unpaid for thirty (30) days after the date of the Warrant torepresent the expenses of said work and improvement. Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the fifteenth day of the next October following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January; every year after the fifteenth day of the next October following their date, until the whole is paid, and the interest shall be p~yable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six (6%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. All of the proceedings for the aforesaid work and improvement and or the issuame of said Bonds shall be had and -2- taken under 81 d in accordance with the provis ions of an Ac t of the Legislature of the State of California, known and designated as the "Improvement Act of 1911, being Division 7, Streets and Highways Code of t he State of California." Reference is hereby made to Resolution of Intention No. 1788 of said City Council, declaring its intention to order said work to be done for further particulars, which Resolution of Intention is on file in the office of the City Clerk of said City of Arcadia. NOW, THEREFORE, BE IT RESOLVED, that said City Council hereby rejects all of said proposals or bids except the next herein mentioned and hereby awards the contract for doing said work and improvement to the lowest, regular, responsible bidder therefor, towit: To Frr:ZQe:-~/rL.-b eIfO//Yt5C,f/ffa fblZJ rj()H~()<9-71~/Y &0. at the prices mentioned in i~proposal on file for said work and improve- ment. The City Clerk is hereby directed to publish notice of this award twice in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and hereby designat ed f or that purpose by said City Council. The City Clerk shall certify to the adoption of this Resolution I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of t he City of Arcadia, held on the 17 day of August, 1948, by the affirmative vote of at least three Councilmen, towit: AYES NOES Councilmen, Boucher, EVing, Klomp, Nugent and Russell . .
