HomeMy WebLinkAbout1830 RESOLUTION NO. l830 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AWARDING CONTRACT FOR CERTAIN WORK AND IMPROVEMENT ON A PORTION OF HUNTINGTON DRIVE IN SAIB CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF' ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. ~REREAS, the City Council of the City of Arcadia did in open session at its regular meeting on February 1st, 1949, publicly open, examine and declare all sealed proposals or bids for doing certain work and improvement on a portion of Huntington Drive in the City of Arcadia; that Resolution of Intention No. 1820 heretofore adopted by this Council on the 21st day of December, 1948, contains a complete description of s aid street work and improvement and reference is hereby made to said Resolution No. 1820, for a complete description of said work and improvement. SECTION 2. That the grade to which the work hereinabove des- cribed shall be done and the improvement made as provided in this Resolution, is shown on Profile and Improvement Plan No. C-175 on file in the office of the City Engineer of said City to which Profile reference is hereby made for t he description of such grade. SECTION 3. All the foregoing work shall be done in accordance with said Profile and Improvement Plan No. C-175 on file in the office of the City Engineer of said City of Arcadia. All work on grading and the construction of concrete sidewalks, shall be in accordance with the following specifications on file in the office of the City Clerk of said City of Arcadia, towit: "Standard Specifications No. 0 for the construction of curbs, side- walks, gutters, oil macadam pavement and concrete pavement". Said Profile and Improvement Plan No. C-175 and the Specifications hereinabove referred to were adopted by Resolution No. 1818 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more parti- cular description of said work. All avenues, drives, roads and place referred to in this Resolution are public avenues, drives, roads, and -1- place of said City of Arcadia. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of said City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby rrakes the expenses of said work and improvement chargeable upon the district benefited by said work and improvement, and to be assessed to pay the costs and expenses thereof, which said district is completely described in Re901ution of Intention No. 1820, heretofore adopted by this Council on the 21st day of December, 1948, and to which Resolution reference is hereby made for a complete description of s aid district to be assesged to pay the costs and expenses of said work and improvement. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty- five ($25.00) dollars, or more, remaining unpaid for thirty (30) days after the date of the warrant to represent the expenses of said work and improvement. Said serial bonds shall extend over a period of nine (9) years from the second day of January next succeeding the next October 15th following their dare and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after their d~e until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each ye~ after their date at the rate of s ix (6%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds and interest thereon 3hall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. All of the proceedings for t he aforesaid work and improvement and/or the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designated as the "Improvement Act of 1911, being Division 7, Streets and Highways Code of the State of California" . Reference is hereby made to Resolution of Intention No. l820 -2- of said City Council, dedlaring its intention to order said work to be done, for further particulars, which Resolution of Intention is on file in the office of the City Clerk of said City of Arcadia. NOW, THEREFORE, BE IT RESOLVED, that said City Council hereby rejects all of said proposals or bids except the next herein mentioned and hereby awards the contract for doing s aid work and improvement to the lowest, regular, responsible bidder therefor, towit: To SERVICE CONSTRUCTION COMPANY OF SOUTHERN CALIFORNIA, at the prices mentioned in its proposal on file for said work and improvement, 'said City Council hereby waiving the necessity for the filing of a non-col- lusion affidavit provided for in these proceedings. SECTION 7. The City Clerk is hereby directed to publish notice of this award twice in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and hereby designated for that purpose by said City Council. SECTION 8. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution. was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 15th day of February, 1949, by the affirmative vote of at least three Councilmen, towit: AYES . .
