HomeMy WebLinkAbout1841 RESOLUTION OF INTENTION NO. 184~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA. DECLARING ITS INTENTION TO FORM A LIGHTING MAINTENANCE DISTRICT, WHICH DISTRICT IS TO PAY THE COST AND EXPENSES FOR T HE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM NOW INSTALLED ON ~ORTIONS OF SANTA ANITA AVENUE, OAKWOOD AVENUE, WILSON AVENUE AND VIRGINIA DRIVE IN SAID CITY, AND l"IXING' A TIME AND PLACE FOR HEARING OBJECT- IONS TO THE FORMATION OF SAID DISTRICT OR TO THE EXTENT THEREOF'. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require and that it is the intention of the City Council of the City of Arcadia to form a lighting maintenance district to be known as Lighting Maintenance District No.2, for the purpose of assessing s aid district to pay a. portion of the cost and expenses of maintaining and operating a street lighting system consisting of twenty-nine (29) 2500 lumen lamps now installed on portions of Santa Anita Avenue, O!kwood Avenue, Wilson Avenue and Virginia Drive. SECTION 2. The items of expense of maintenance and operation of the said lighting system to be furnished and to be assessed in part against the lands within the district, (exclusive of improvements), are electric power, repairs, replacements, labor. materials. engineer- ing, printing and advertising. The estimated amount of electric power necessary for said system for each year is sixteen thousand seventy seven (16,077) Kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of $271.44 and that The estimated cost of all other items of maintenance and operation of said system for the first year is the SllDl of $705.44. SECTION 3. That t he said contemplated maintenance and operation of said lighting system in the opinion of the City Council of the City of Arcadia is of more than local or ordinary public benefit and said City Council hereby makes the expense of said maintenance and operation. exclusive of the amount to be paid by said City as stated in Section 5 hereof, charge~ble upon a district, which district said City Councili hereby declares to be the district benefited by said maintenance and operation and to be assessed to pay the cost and expenses thereof; which said district shall include all the lots in Tract No. 13367 and -,- .' ".r_~:"h Tract No. 10725 in said City of Arcadia. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed district was approved and adopted by Resolution No. 184G of the City Council of said City of Arcadia, and is on file in the office of the City Clerk of the City of Arcadia. Reference is hereby made to said plat or map for further~ full and complete description of said Lighting Maintenance District No. a, and said map so on file shall govern for all details as to the extent of such district. SECTION 4. That said maintenance and operation shall be fur- nished for said system for a period of five years from the date of the formation of said district. SECTION 5. The City Council of the City of Arcadia hereby orders that fifty (50%) per cent of the total maintenance and operation cost and expenses of said system be paid out of the treasury of said City from the general fund of said City. SECTION 6. Notice is hereby given that on Tuesday, the 15th day of March, 1949, at the hour of 8:00 O'clock. P.M. of said day, in the Council Chambers of said City Council of said City of Arcadia, in the City Hall of said City, any and all persons owning land or having any interest in lands within the district liable to be assessed for the expenses of said maintenance and operation or any portion thereof, may be heard and any of said persons may present any object- tions that they may have by protest. SECTION 7. All the proceedings for the aforesaid maintenance and operation of said system shall be had and taken under and in accordance with the provisions of an act of the Legislature of the State of California known and designated as the Munici~al Lighting Maintenance District Act of 1927, being Division 14, Part 3 of the Streets and Highways Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this resolution headed "Notice of formation of lighting maintenance district'! along all open streets wi thin said! district liable to be assessed, in the manner and form required by -2- iiaw. SECTION 9. The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be published twice in the Arcadia Tribune and Arcadia News, a newspaper of general circulation published and circulated in the City of Arcadia and hereby designated for that purpose.
