HomeMy WebLinkAbout1849 RESOLUTION OF INTENTION NO.1849 I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALI- FORNIA, DECLARING ITS INTENTION TO IMPROVE AN EASEMENT KNOWN AS OAK VIEW LANE, AND OTHER EASEMENTS IN SAID CITY OF ARCADIA. AND DECLARING SAID WORK OR IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENE- FITED BY SAID WORK OR IMPROVEMENT AND T 0 BE ASSESSED TO PAY A PORTION OF THE COSTS AND EXPENSES THEREOF. AND DETERMINING THAT SERIAL BONDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EXPENSES AND FIXING THE TIME FOR HEARING OBJECTIONS TO SAID WORK OR IM- PROVEMENT, OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE, ORDER, AND DETERMINE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Arcadia, to order the following work and improvement to be done in said City of Arcadia. to-wit: The construction of certain water pipe lines, connections, and appurtenances and appurtenant work in an easement described as follows: The southerly 10 feet of the easterly 158.76 feet of Lot 7 of Tract No. 13894, as shown on map recorded in Book 289 at pages 3 and 4 of Map Records of Los Angeles County; the wes terly 10 feet of that portion of lot 8 of Block 98 of Santa Anita Tract, as shown on map re- corded in Book 34 at pages 41 and 42 of Miscellaneous Records of Los Angeles County, lying between the easterly prolongation of the south line of said lot 7 and the southwesterly line of the right of way of the Los Angeles County Flood Control District, as described in deed recorded in Book 16849 at page 232 of Official Records of Los Angeles County; th~ portion of lots 8 and 9 of Block 98 of said Santa Anita Tract, being a strip of land 25 feet wide lying westerly of and ad- jacent to the westerly line of the above described Los Angeles County Flood Control right of way and lying between the southerly line of Grand View Avenue and a line parallel therewith and 786.24 feet southerly therefrom, except that portion thereof not within the City of Arcadia; and the south 15 feet of t he north 786.24 feet of lot 9 of Block 98 of said Santa Anita Tract, except the westerly 177 feet thereof. -1- ~..~!J ,,,,I> SECTION 2. That the grade to which the work hereinbefore des- cribed shall be done and the improvement made as provided in this resolution is shown on Profile and Improvement Plan No. C-178, on file in the office of the City Engineer of said City, to which Profile reference is hereby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in accordance ~ with said Profile and Improvement Plan No! C-178 on file in the office of the City Engineer of said Ci ty of Arcadia. All work on the installation of said water line and appurtenances shall be in accordance with the following specifications on file in the office of the City Engineer of said City ot Arcadia, to-wit: "Special Specifications tor the Installation of Water Pipe Lines on Oak View Lane". All work on the replacement 0 f pavement in connection with the installa tion of s aid water pipe shall be in accordance with the follow- ing specifications on tile in the office of the City Engineer of said Cit~ of Arcadia, towit: "Specifications for Pre-Mix Pavement and Wearing Surface"'. Said Profile and Improvement Plan No. C-178 and the Specifications hereinabove referred to were adopted by Resolution No. 1847, of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more particular description of said work. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement, exclusive of the amount to be paid by said City as stated in Section 5 hereof, chargeable upon the District. which District said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses thereof. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed Assessment District, was approved and adopted by Resolution -2- No. 1848 of the City Council of s aid City of Arcadia. and is on file in the office of the City Engineer of the City of Arcadia. Reference is hereby made to said plat or map for further, full. and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-50, and said map so on file shall govern for all details as to the extent of such Assessment District. SECTION 5. The City CoUncil of the City of Arcadia hereby orders that twenty-five (25%) per cent of the total cost of said work and im- provement be paid out of the treasury of said City from the Special Fund for Capital Outlays in the Water Department of said City. SECTION 6. Said City Council also determines, and declares that Serial Bonds shall be issued to represent each assessment of Twenty- five ($25.00) dollars, ,or more, remaining unpaid for thirty (30) days after the date of the warrant to represent the expenses of said work and improvemen~ Said serial bonds shall extend over a period of nine (9) years from the second day of January next succeeding the next October 15th following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after thei~ date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six (6%~ per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds and interest thereon shall be payable at the office of the City Treasurer of t he City of Arcadia. SECTION 7. Notice is hereby given that on Tuesday, the 5th day of April, 1949, at the hour of 8:00 O'clock P. M., on said day, in the Council Chamber of the City Hall in said City of Arcadia, any and all persons having objections to s aid proposed work or improvement or to the extent of the district to be assessed, or both, may appear before said City Council and show cause why said proposed work or improvement should not be carri8d out in accordance with this resolution. -3- SECTION 8. All proceedings for t he aforesaid work and improvement and for the issuance of said bonds shall be had and taken under and in accordance with the provisions of an Act of t he Legislature of the State of California, known and designated as the "Improvement Act of - 1911", being Division 7 of streets and Highways Code of the state of California. SECTION 9. Notice i s hereby given that in accordance with the provisions cr: Section 2804 of t he Streets and Highways Code of the State of California, as amended, the written walvel' of the owners of more than 60% in area of the property subject to assessment for said proposed improvement described herein having been signed and filed with .the City Clerk of the City of Arcadia, the investigation and the report of the City Engineer provided for in the Special Assessment Investigation. Limitation and Majority Protest Act of 1931, being Division 4 of the Streets and Highways Code of the State of califonnia. are hereby speci- fically waived. SECTION 10. The SUpl rintendent of Streets shall post 0 r cause to be posted conspicuously along the line of said contemplated work or improvement and also along all the open streets within the district liable to be assessed and hereinabove described, noticesJof the passage of this resolution in the manner and form required by law. SECTION 11. The City Clerk shall certify tot he adoption of this Resolution and shall cause t he same to be published twice in t he Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and cil'culated in the City of Arcadia and hereby design~ed for that purpose; the City Clerk shall also mail notice of the adoption of this Resolution to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for'City taxes, or as known to said Clerk. Such notice shall be given in the manner and form required by said "Improvement Act of 1911, being Division 7. Streets and Highways Code of the state of Californian. I HEREBY CERTIFY that the foregoing Resolution was adopted at a -4- regular meeting of the City Council of the City of Arcadia, held on the 15th day of March, 1949, by the affirmative vote of at least three Councilmen, towit: . .
