RESOLUTION OF INTENTION NO. 1856
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DECLARING ITS INTENTION TO IMPROVE A PORTION
OF PALM DRIVE IN S AID CITY OF ARCADIA, AND DECLARING SAID
WORK OR IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY
PUclLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED
BY SAID IVORK OR IMPROVEMENT AND TO BE ASSESSED TO PAY THE
COSTS AND EXPE NSES THEREOF, AND DETERMINING THAT SERIAL
BONDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EXffi NSES
AND FIXING A TI~m FOR HEARING OBJECTIONS TO SAID WORK OR
IMPROVEMENT. OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED
OR BOTE.
THE OITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS
FOLLOWS:
~ECTION 1. That the public interest and convenience require,
and it is the intention of the City Council of the City of Arcadia.
to order the following work and improvement to be done in said City
of Arcadia, to-wit:
FIRST: That a concrete curb be constructed along each side of
the roadway of Palm Drive, from the westerly line of Santa Anita
Avenue to the westerly line of Tra~t No. 4870 as shown on map
recorded in Book 56 at page 24 of Maps, Records of Los Angeles:
County, and also that a concrete curb be constructed around the
return at the northwest corner of Palm Drive and Santa Anita Avenue,
except where such concrete curb is now in place to the official line
and grade, and is in good condition.
SECOND: That a concrete gutter be constructed along each side
of the roadway of Palm Drive from the westerly line of Santa Anita.
Avenue to the westerly line of said Tract No. 48701, and also that a
concrete gutter be constructed around the curb return at the south-
westerly corner of Palm Drive and Santa Anita Avenue, and also that
a concrete gutter be constructed around and adjacent to the curb
return at t he northwesterly corner of Palm Drive and Santa Anita
Avenue.
THIRD: That the portion of the roadway of Palm Drive between
the northerly gutter line thereof and the existing macadarn1pavement
in said portion of Palm Drive. between a line eight feet easterly
from ~~d parallel to the westerly line of Santa Anita Avenue and the

westerly line of said Tract No. 4870 be graded and paved with an
oil macadam pavement two and one-quarter (2 1/4") inches thick,
and also that the portion of the roadway of Palm Drive between the
southerly gutter line thereof and the existing macadam pavement
in said portion of Palm Drive, between a line eight feet easterly
from and parallel to the westerly line of Santa Anita Avenue and
the westerly line of said Tract No. 4870 be graded and paved with
an oil macadam pavement two and one-quarter (2 1/411) inches thick.
except where such oil macadam pavement is now in place to the
official line and grade, and is in good condition.
SECTION ~. The grade to which the ~rk shall be done and
improvement made which is provided for in this Resolution of In-
tention shall be that shown on the Profile and Improvement Plan
No. C-176, on file in the office of the City Engineer of said City,
and reference is hereby made to said plans and profiles for a des-
cription of such grade.
SECTION 3. That all of the foregoing \11) rk and improvement shall
be done in accordance with said Profile and Improvement Plan No. C-l?6
on file in the office of the City Engineer of said City of Arcadia.
That all of the foregoing work on grading and the construction
of concrete curbs, and concrete gutters shall be in accordance with
the following specifications on file in the office of the City Engineer
of the City of Arcadia, to-wit: "Standard Specification No. 0 for the
construction of curbs. sidewalks, gutters, oil macadam wd concrete
pavement."
That all of the foregoing work on the construction of street
pavement shall be in accordance with the following specifications on
file in the office of the City Engineer of the City of Arcadia, to-wit:
"Standard Specifications No. 3 for the construction of ~ 1/4 inch oil.
macadam pl. vement and resurfacing."
Said Profile m d Improvement Plan No. C-176 and the specifications
hereinabove referred to were adopted by Resolution No. 1854 of said
City Council of the City of Arcadia, and the same are hereby made a

part of this resolution and are hereby referred to for a more par-
ticular description of said work. All avenues and drives referred
to in this resolution are public avenues and drives of said City.
SECTION 4. That said contemplated work and improvement in the
opinion of the City Council of the City of Arcadia, is of more than
local or ordinary public benefit and said City Council hereby makes
the expense of said work and improvement chargeable upon the District,
which district said City Council hereby declares to be the District
benefited by said work and improvement and to be assessed to pay the
costs and expenses thereof, which s aid District shall include all
those lots in the said City of Arcadia, County of Los Angeles, state
of California, fronting on and adjacent to said Palm Drive from the
westerly line of Santa Anita Avenue to the westerly line of Tract
No. 4870 aforesaid.
A plat or map of said District indicating by a boundary line the
extent of the lands included in the proposed Assessment District,
was approved and adopted by Resolution No. 1854 of the City Council
of said City of Arcadia, and is on file in the office of the City
Engineer of the City of Arcadia. Reference is hereby made to said
plat or map for further, full and complete description of said Assess-
ment District, which said plat or map is designated as Assessment
District no. W-48, and said map so on file shall govern all details
as to the extent of such Assessment District.
SECTION 5. Said City Council also determines and declares that
Serial Bonds shall be issued to represent each assessment of Twenty-
five (~25.00) dollars, or more, remaining unpaid for thirty (30) days
after the date of the warrant to represent the expenses of said .ork
and improvement. Said serial bonds shall extend over a period of nine
(9) years from the second day of January next succeeding the next
October 15th following their date and an even annual proportion of the
principal sum thereof shall be payable by coupon on the second day of
January of each year, following the next October 15th after their date,
until the whole is paid, and the interest shall be payable semi-annually

by coupon on the second days of January and July respectively of each
year after their date at the rate of six (6%) per cent per annum on
all sums unpaid until the whole of said principal and interest are
paid. Said bonds and interest thereon shall be payable at t he office
of the City Treasurer of the city of Arcadia.
SECTION 6. Notice is hereby given that on Tuesday, the 3rd day
. of May, 1949, at the hour of 8:00 o'clock P.M. on said day, in the
Council Chamber of the City Hall in said City of Arcadia, any and all
persons having objections to said proposed work or improvement or to
the extent of the district to be assessed, or both, may lppear before
said City Council and show cause why said proposed work or improvement
should not be carried out in accordance 'with this resolution.
SECTION 7. All proceedings for the aforesaid \~rk and improve-
ment and for the issuance of said Bonds shall be had and taken under
and in accordance with the provisions of an Act of the Legislature of
the state of California, mown and designated as the "Improvement Act
of 1911", being Division 7 of streets and Highways Code of the State
of California.
SECTION 8. Notice is hereby given that in accordance with the
provisions of Section 2804 of the Streets and Highways Code of the
State of California, as qmended, the written waiver of the owners of
more than 60% in area of the property subject to assessment for said
proposed improvement described herein having been signed and filed
with the City Clerk of the City of Arcadia, the investigation and the
report of the City Engineer provided for in the Special Assessment
Investigation, Limitation ~~d Majority Protest Act of 1931, being
Division 4 of the Streets and Highways Code of the state of California,
are hereby specifically waived.
SECTION 9. The Superintendent of Streets shall post or cause to
be posted conspicuously along the line of said contemplated work or
improvement and also along all the open streets within the district
liable to be assessed and hereinabove described, notices of the passage
of this resolution in the manner and form required by law.
S:&;CTION 10. The City Clerk shall certify to the adoption of this

resolution and shall cause the same to be published twice in the Arcadia
Tribune and Arcadia News, a newspaper of general circulation, pub-
lished and circulated in the City of Arcadia and hereby designated for
that purpose; the City Clerk sh~l also mail notice of the adoption
of this resolution to all persons owning real property proposed to be
assessed, whose names and addresses appear on the last equalized assess-
ment roll for city taxes, or as known to said Clerk. Such notice shall
be given in the manner and form required by said "Improvement Act of
1911, being Division 7, Streets and Highways Code of the state of
California".
I HEREBY CERTIFY that the foregoing Resolution was adopted at
a regular meeting of the city Council of the City of Arcadia, held on
the 5th day of April, 1949, by the affirmative vote of at least three
Councilmen, to wit:
