HomeMy WebLinkAbout1859 RESOLUTION NO. 185a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARlftG ITS INTENTION TO IMPROVE PORTIONS OF ELDBRADO STREET, FANO STREET, GENOA STREET, AND ALICE STREET IN SAID CITY OF ARCADIA, AND DECLARING SAID WORK OR IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK OR IMPROVEMENT AND TO BE ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF, AND DETERMINING THAT SERIAL BONDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EXPENSES AND FIXING A TIME FOR HEARING OBJECTIONS TO SAID WORKOR IMPROVEMENT, OR TO THE EXTElfl OF THE DISTRICT TO BE ASSESSED, OR BOTH. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Arcadia to order the following work and improvement to be done in said City of Arcadi a, towi t : FIRST: That a concrete curb be constructed along each side of Eldorado Street from the westerly line of First Avenue to the easterly line of Santa Anita Avenue. That a concrete curb be constructed along each side of Fano Street from the westerly line of First Avenue to the easterly line of Santa Anita Avenue. That a concrete curb be constructed along each side of Alice Street from the westerly line of Second Avenue to the easterly line of Santa Anita Avenue, including curb returns at the intersection of Alice Street and the two alleys west of First Avenue, and at the intersection of Alice Street and Santa Anita Avenue, except where such concrete curb is now in place to the official line and grade, and is in good condition. SECOND: That a concrete gutter be constructed along each side of Eldorado Street from the westerly line of First Avenue to the easterly line of Santa Anita Avenue. That a concrete gutter be constructed along each side of Fano Street from the westerly line of First Avenue to the easterly line of Santa Anita Avenue. That a concrete gutter be constructed along each side of Genoa -1- INDEX~~ street from the westerly line of Second Avenue to the easterly line of Santa Anita Avenue, except where such concrete gutter is now in place to the official line and grade. and is in good condition. That a concrete gutter be constructed along each side of Alice Street from the westerly line of Second Avenue to the easterly line of Santa Anita Avenue, including around the curb return at the south- easterly corner of the intersectionof Alice Street with Santa Anita Avenue, and including a cross gutter across Alice Street near Santa Anita Avenue, except where such concrete gutter is now in place to the official line and grade, and is in good condition. THIRD: That a concrete widewalk be constructed along each side of Eldorado Street from the westerly line of First Avenue to the Easterly line of Santa P~ita Avenue, including the returns at the intereectionof Eldorado street and Santa Anita Avenue. That a concrete sidewalk be constructed along each side of Fano Street from the westerly line of First Avenue to the easterly line of Santa Anita Avenue, including the returns at the intersection of Fano Street and Santa Anita Avenue. FOURTH: That the portion of the roadway between the~tter lines md the existing macadam pavement. in Eldorado Street, from the westerly line of First Avenue to the easterly line of Santa Anita Avenue, be graded and paved with an oil macadam pavement. That the portion of the roadway between the@ltter lines and the existing macadam pavement in Fano Street. from the westerly line of First Avenue to the easterly line of Santa Anita Avenue, be graded and paved with an oil macadam pavement. That the portion of the roadway between the gutter lines and the existing macadam pavement in Genoa Street, from the westerly line of Second Avenue to the easterly line of Santa Anita Avenue, be graded and paved with an oil macadam pavement, except where such macadam pavement is now in place to the official line and grade, and is in good condition. That the portion of the roadway between the gutter lines and the existing macadam pavement in Alice Street, from the westerly line of -2- Secpnd Avenue to the easterly line of Santa Anita Avenue, be graded and paved with an oil macadam pavement, except where such macadam pavement is now in place to the official line and grade, and is in good condition. SECTION 2. That the grade to vlhich the work hereinbefore described shall be done and the 'improvement made as provided in this resolution is shown on Profile and I~provement Plan No. C-177, sheets 1 to 4 inclusive, on file in the office of the City Engineer of said City, to which Profile reference is hereby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in accordance with said Profile and Improvement Plan No. C-177, sheets 1 to 4 in- clusive, on file in the office of the City Engineer of said City of Arcadia. All work on grading and the construction of concrete curbs, concrete gutters and concrete widewalks shall be in accordance with the following specifications on file in the office of the City Engineer of said City of Arcadia, tOl'lit: "Standar d specifications No. 0 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement". All work on construction of oil macadam pavement shall be in accordance with the following specifications on file in the office of the City Engineer of said City of Arcadia, tOl'lit: "Standard Specifications No. 3 for t he cons truction of 2t" oil macadam pavement and resurfacing". Said Profile and Improvement Plan No. C-177 and the specifications hereinabove referred to were adopted by Resolution No. 1858, of said eity Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more par ticular description of said work. The streets and avenues referred to in this Resolution are public streets and avenues of the City of Arcadia. SECTION 4. That said contemplated work and improvement, in the -3- opinion of the City Council of the City of Arcadia, is of ~ore than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District which district said City Council hereby declares to be t he District benefited by said work and improvement and to be asseseed to pay the costs and e~penses thereof. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed Assess- ment District. was approved and adopted by Resolution No. 1857 of the City Council of s aid City of Arcadia, and is on file in the office of the City Engineer of the City of Arcadia. Reference is hereby made to the said plat o~ map for further, full and complete descriptionof said Assessment District, which said plat or map is designated as Assessment District No. W-49, and said map so on file shall govern for all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines md declares that Serial Bonds shall be issued to represent each assessment of Twenty- five ($25.00) Dollars, or more, remaining unpaid for thirty (30) days after the date of the warrant to represent the expenses of said work and improvement. Said serial bonds shall extend over a period of nine (9) years from the second day of January next succeeding the next October 15th following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after t heir date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second d~s of January and July respectively of eam year af ter t heir date at the rate of six (6%) per cent per annum on all sums unpaid until the whole of said principal and interest ~e paid. Said bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 5. Notice is hereby given that on Tuesday, 17ft the .;;r-d day of May, 1949, at the hour of 8:00 o'clock P. M., on said day, in the Council Chamber of the City Hall in said City of Arcadia, any and dl persons having objections to s aid proposed work or improvement or to -4- .~ the extent of the district to be assessed, or both, may appear before said City Council and show cause why said proposed work or improvement should not be carried out in accordance with this resolution. SECTION 7. All proceedings for the aforesaid work and improve- ment and for the issuance of sai. d bonds shall be had and taken under and in accordance with the provisions of an Act of t he Legislature of the State of California, known and designated as the "Improvement Act of '.1911", being Division 7 of streets and Highways Code of the State of California. SBCTION 8. The report of the City Engineer, as required to be made by the provisions of the Special Assessment, Investigation, Limitation and Majority Protest Act of 1931, being Division 4, Streets and Highways Code aforesaid, and the report on the hearing required to be held as provided in said Act, are on file in the office of the City Clerk of the ,City of Arcadia, are open to public inspection. and may be examined at his office in the City Hall of the City of Arcadia. SECTION 9. The Superintendent of Streets shall post or cause to be posted conspicuously along the line of said contemplated work or improvement and also along all the open streets within the district liable to be assessed and hereinabove described, notices of the passage of this Resolution in the manner and form required by law. SECTION 10. The City Clerk shall certify to the adoption of this resolution and shall cause the sane to be published twice in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, pub- lished and circulated in the City of Arcadia and hereby designated for that purpose; the City Clerk shall also mail notice of the adoption of this resolution to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assess- ment roll for City taxes, or as known to said Clerk.
