HomeMy WebLinkAbout1864 RESOLUTION NO. l864 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ORDERING CERTAIN WORK AND I MPROVEMENT TO BE DONE ON A PORTION OF PALM DRIVE, IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require that certain work and improvement be done in the City of Arcadia, and the City Council of the City of Arcadia hereby orders the same to be done, in accordance with Specifications and Improvement Plan No. C-176, on file in the office of the City Engineer of said City of Arcadia, adopted for said work and under the direction and to the satisfaction of the Superintendent of Streets of said City of Arcadia; that Resolution of Intention No. 1856 her~tofore adopted by this Council on the 5th day of April, 1949, contains a complete description of the work and improve- ment to be done pursuant to this Resoluti. on, and reference is hereby / made to s aid Resolution of Intention No. 1856 for a complete deS"criptim of said work and improvement. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution is shown on Profile and Improvement Plan No. C-176 on file in the office of the City Engineer of said City, to which Profile reference is hereby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in accordance with said Profile and Improvement Plan No. C-176 on file in the office of the City Engineer of said City of Arcadia. All work on grading and the construction of concrete gutters shall be in accordance with the following specifications on file in the office of the City Engineer of the City of Arcadia, towit: "Standard Speci- fications No. 0 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement." All work on the construction of street pavement shall be in accor- dance with the following specifications on file in the office of the City Engineer of the City of Arcadia, towit: "Standard Specifications -1- INDEXE~ No. 3 for the construction of 2~ inch oil macadam pavement and re- surfacing. II Said Profile and Improvement Plan No. C-176 and the specifications hereinabove referred to were adopted by Resolution No. 1854 of said City Council of the City of Arcadia, and the same are hereby made a part of this resolution and are hereby referred to for a more particular des- cription of said work. All streets and avenues referred to im this resolution are public streets and avenues of s aid City. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District which District said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which said District shall include all those lots in the said City of Arcadia, fronting on and adjacent to said portion of Palm Drive, from the westerly line of Santa Anita Avenue to the westerly line of Tract No. 4870 therein. A plat or map of said District indicating by a boundary line the extent of the lands included in said District was approved and adopted by Resolution NO. 1855 of the City of Arcadia on the 5th day of April, 1949, and is on file in the office of the City Engineer of the City of Arcadia; reference is hereby made to said plat or map for a further, full and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-48, and said map so on file shall govern for all details as to the extent of such assessment District. SECTION 5. Said City Council also determines and declares th~ Serial Bonds shall be issued to represent each assessment of Twenty~five dollars ($25.00), or more, remaining unpaid for thirty (30) days after the dEt e of the Warrant to r epreaent the elxpenses of said work and improvement s Said Serial Bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October l5th following their date and an even annual proportion of the principal sum thereof -3- shall be payable by coupon on the second day of January of each year, following the next October 15th after their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six per cent (6~) per annum on all sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable ht the office of the City Treasurer of the City of Arcadia. SECTION 6. All proceedings for the aforesaid work and improvement and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designat ed as the "Improvement Act of 1911, being Divisidn 7, Streets and Highways Code of the State of California." SECTION 7. The Arcadia Tribune and Arcadia News, a weekly newspaper of general circulation, published and circulated in said City of Arcadia, is hereby designated as the newspaper in which notice of said work and improvement inviting sealed proposals sh&l be published in the manner and f arm and by the persons required by law. SECTION 8. The City Clerk of said City of Arcadia is hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together with the Specifications therefor, inviting sealed proposals or bids for doing said work and said City Clerk is also directed to pub- lish twice in said newspaper designated as aforesaid in the manner and form required by law, a notice inviting sealed proposals or bids for doing said work, and referring to the Specifications posted or on file. Said notice shall require a certified check or bond, either, as prescribed by law for an amount not less than ten per cent of the aggregate of the pro- posal. Said sealed proposals or bids shall be delivered to the City Clerk of said City of Arcadia on or before eight O'clock P. M., on May 17,1949; bids will be opened on said day and hour. -3- SECTION 9. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 3rd day of May, 1949, by the affirmative vote of at least three Councilmen, towit: AYES . .
