HomeMy WebLinkAbout1875 RESOLUTION NO. 1875 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AWARDING CONTRACT FOR CERTAIN WORK AND IMPROVEMENT ON A ~ORTION OF PALM DRIVE IN SAID CITY OF ARCADIA: THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. WHEREAS, the City Council of the City of Arcadia did in open session at its regular meeting on May 17, 1949, publicly open, examine and declare all sealed proposals or bids for doing certain work and improvement on a portion of Palm Drive in said City of Arcadia; that Resolution of Intention No. 1856 heretofore adopted by this Council on the 5th day of April, 1949, contains a complete description of said work and improvement and reference is hereby made to said Resolution of Intention No. 1856 for a complete description of said work and improvement. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution, is shown on Profile and Improvement Plan No. C-176, on file in the office of the City Engineer of said City to which Profile reference is hereby made for the description of such grade. SECTION 3. That all of the foregoing work and improvement shall be done in accordance with said Profile and Improvement Plan No. C-l76 on file in the office of the City Engineer of said City of Arcadia. That all of the foregoing work on grading and the construction of concrete curbs, and concrete gutters shall be in accordance with the following specifications on file in the office of the City Engineer of the City of Arcadia, towit: "Standard Specification No. 0 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement." That all of thefforegoing work on the construction of street pavement shall be in accordance with the following specifications on file in the office of the City Engineer of the City of Arcadia, towit: "Standard Specifications No. :3 for the construction of 2 1/4 inch oil -1- INDEXED macadam Pavement and resurfacing." Said Profile and Improvement Plan No. C-176 and the specifications hereinabove referred to were adopted by Resolution No. 1854 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more parti- cular description of said work. All avenues and drives referred to in this resolution are public avenues and drives of said City. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, which district said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which said District shall include all those lots in the said City of Arcadia, County of Los Angeles, state of California, fronting on and adjacent to said Palm Drive from the westerly line of Santa Anita Avenue to the westerly line of Tract No. 4870 aforesaid. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed Assessment District, was approved and adopted by Resolution No. 18515 , of the City Council of said City of Arcadia, and is on file in the office of the City Engineer of the City of Arcadia. Reference is hereby made to said plat or map for further, full, and complete description of said Assess- ment District, which said plat or map is designated as Assessment District No. W-48, and said map so on file shall govern all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines. and declares that Serial Bonds shall be issued to represent each assessment of Twenty- five ($25.00) dollars, or more, remaining unpaid for thirty (30) days after the date of the warrant to represent the expenses of said work and improvement. Said serial bonis shall extend over a period of nine (9) years from the second day of January next succeeding the next -2- October 15th following their date and ~ even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next Ocro ber 15th after their date, until the whole is paid, and the interest shall be paywle semi-annually by coupon on the second days of January and July respectively of each year after their date at the rate of six (6%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. All of the proceedings for the aforesaid work and improvement and for the issuance of said Bord s shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designElted as the "Improvement Act of 19l1, being Division 7, Streets and Highways Code of the state of California." Reference is hereby made to Resolution of Intention No. 1856, of said City Council, declaring its intention to order said work to be done, for further particulars, which Resolution of Intention is on file in the office of the City Clerk of said City of Arcadia. NOW, THEREFORE, BE IT RESOLVED, that said City Council hereby re- jects all of said proposals or bids except the next herein mentioned and hereby awards the contract for doing said work and improvement to the lowest, regular, responsible bidder therefor, towit: To HARVEY CONSTRUCTION COMPANY, at the prices mentioned in it's pro- posal on file for said work and improvement. The City Clerk is hereby directed to publish notice of this award twice in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia and hereby designated for that purpose by said City Council. The City Clerk shall certify to the adoption of this Resolution. -3- I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 17th day of May, 1949,by the affirmative vote of at leaat three Councilmen, towit: AYES . .
