HomeMy WebLinkAbout1900 RESOLUTION OF INTENTION NO. 1900 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF &qCADIA, CALIFORNIA, DECLARING ITS INTENTION TO IMPROVE A PORTION OF THE FIRST ALLEY SOUTH OF HUNTINGTON DRIVE IN SAID CITY OF ARCADIA, AHD DECLARING SAID i'iORK OR IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BEHEFIT AHD DESCRIB- ING THE DISTRICT TO BE BE~~FITED BY SAID WORK OR IMPROVE- 1ENT AND TO BE ASSESSED TO PAY THE COSTS fu~D EXPENSES THEREOF, AND DETERMINING THAT SERIAL BOrIDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EXPENSES AND FIXING A TIr:ffi FOR HEARING OBJECTIONS TO SAID WORK OR IMPROVEMENT, OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED OR BOTH. THE CITY COUNCIL OF TEE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1.. That the public intel'est a'1d convenience require, and it is the intention of the City Council of the City of Arcadia to order the following work and improvement to be done in said City of Arcadia, to wi t : FIRST: That a cement concrete gutter three feet (3') in width, be constructed along a line fourteen feet (14') southerly from and parallel with the northerly line of the First Alley South of Huntington Drive, fl'om the easterly line of Santa Anita Avenue to the westerly line of Second Avenue, except where such concrete gutter is now in place to the official line and grade, and is in good condition. SECOND: That the portion of the said alley between a line one foot (11) southerly from and parallel with the northerly line of said alley and the northerly gutter line thereof, from the easterly line of Santa Anita Avenue to the westerly line of Second Avenue be graded and paved with asphaltic concrete pre-mix pavement two and one- quarter inches (2i") in thickness, and also that the portion of the said alley between a line one foot (I') northerly from and parallel with the southerly line of said alley and the southerly gutter line thereof, from the easterly line of Santa Anita Avenue and the westerly line of Second Avenue be graded and paved with asphaltic concrete pre- mix pavement two and one-quarter inches (2i") in thickness, except where such asphaltic concrete pre-mix pavement, or oil macadam pavement is now in place to the official line and grade, and is in good condition. THIRD: That a cement concrete apron six inches (6") in thickness: -1- ,:.~~'1 be constructed in the intersection of Santa Anita Avenue with the westerly termination of the First Alley South of Huntington Drive, from a line six feet (61) westerly from and parallel with the easterly line of Santa Anita Avenue to the easterly line of Santa Anita Avenue, and also that a cement concrete apron six inches (6") in thickness be constructed in the intersection of Second Avenue with the easterly termination of the First Alley South of Huntington Drive, from a line twelve feet (12') easterly from and parallel with the westerly line of Second Avenue to the westerly line of Second Avenue, except where such cement concrete apron is now in place to the official line ~d grade, and is in good condition. SECTION 2. The grade to which the work shall be done and improve- ment made which is provided for in this Resolution of Intention shall be that shown on the Profile and Improvement Plan No. C-179, on file in the office of the City Engineer of said City, and reference is hereby made to said plans and profiles for a description of such grade. SECTION 3. That all of the foregoing work and improvement shall be done in accordance with said Profile ~d Improvement Plan No. C-179 on file in the office of the City Engineer of said City of Arcadia. That all of the foregoing ',vork on grading and the construction of cement concrete gutters, cement concrete pavement shall be in accordance with the following specifications on file in the office of the City Ene;ineer of the City of Arcadia, to wit: "Standard Specification No. 0 and No. 1 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement." That all of the foregoing work on the construction of street pavement shall be in accordance with the following Specifications on file in the office of the City Engineer of the City of Arcadia, to-wit: "Specifications for Asphaltic Concrete Pre-Mix Pavement and Wearing Surface." Said Profile and Improvement Plan No. C-179 and the specifications hereinabove referred to were adopted by Resolution No. 1896 of said City Council of the City of Arcadia, and the srune are hereby made a part of -2- of this resolution and are hereby referred to for a more particular description of said work. All alleys, streets and avenues referred to in this resolution are public alleys, streets and avenues of said Ci ty. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, which district said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which said District shall include all those lots in the said City of Arcadia, County of Los Angeles, state of California, abutting on and adjacent to the said First Alley South of Huntington Drive from a line six feet (61) westerly from and parallel wi th the easterly line of Santa Anita Avenue to a line twelve feet (12,1) easterly from and parallel with the westerly line of Second Avenue. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed assessment District, was approved and adopted by Resolution No. 1895 of the City Council of said City of Arc adia, and is on file in the office of the City Engineer of the City of Arcadia. Reference is hereby made to said plat or map for further, full and complete description of said assessment District, which said plat or map is designated as Assessment District No. W-51, and said map so on file shall govern all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty- five ($25.00) DOllars, or more, remaining unpaid for thirty (30) days: after the date of the warrant to represent the expenses of said work and improvement. Said serial bonds shall extend over a period of nine (9) years from the second day of January next succeeding the next October 15th following their date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next Oc tober 15th after their date" -3- until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July respectively of eadh year after their date at the rate of six (6%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. Notice is hereby given that on Tuesday, the 6th day of September, 1949, at the hour of 8:00 olclock P.M. on said day, in the Council Chmnber of the city Hall in said City of Arcadia, any and all persons having objections to said proposed work or improvement or to the extent of the district to be assessed, or both, may appear before said City Council and shaw cause why said proposed \'Iork or improvement should not be carried out in accordance with this resolution. SECTION 7. All proceedings for the aforesaid Vlork and improve- ment and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designated as the "Improvement Act of 19l1", being Division 7 of Streets and Highways Code of the state of California. SECTION 8. Notice is hereby given that in accordance with the provisions of Section 2804 of tho Streets and Highways Code of the State of California, as amended, the written waiver of the owners of more than 60% in area of the property subject to assessment for said proposed improvement described herein having been signed and filed with the City Clerk of the City of Arcadia, the investigation and the report of the City Engineer provided for in the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, being Division 4 of the Streets and Highways Code of the ~te of California, are hereby specifically waived. SECTION 9. The Superintendent of streets 3hall post or cause to be posted conspicuously along the line of said contemplated \wrk or improvement and also along all the open streets within the district liable to be assessed and hereinabove described, notices of the passage of this resolution in the manner and form required by law. -4- SECTION 10. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published twic~ in the Arcadia ,~ ~r1bun~:&n~XA~Gatl1~~Naw~1 a newspaper of general circulation, pub- lished and circulated in the City of Arcadia and hereby designated for that purpose; the City Clerk shall also maim notice of the adoption of this resolution to all persons owning real property proposed to be assessed, whose n~~es and addresses appear on the last equalized assess- ment roll for City taxes, or as known to said Clerk. Such notice shall be given in the manner and form required by said "Improvement Act of 1911, being Division 7, Streets and Highways Code of the State of California".
