HomeMy WebLinkAbout1915 RESOLUTION NO. 1915 A RESOLUTION OF TIill CITY COUNCIL OF THE CITY OF ARCADIA ORDERING CERTAIN WORK AND IMPROVE~illf~ TO BE DONE ON PORTION OF THE FLRST ALLEY SOUTH OF HUNT- INGTON DRIVE, IN THE CITY OF ARCADIA. THE CITY COm~CIL OF TF~ CITY OF ARCADIA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require that certain work and improvement be done in the City of Arcadia, and the City Council of the City of pxcadia hereby orders the same to be done in accordance with Specifications and Improvement Plan No. C-170, on file in the office of the City Engineer of said City of Arcadia, adopted for said work and under the direction and to the satisfaction of the Superintendent of Streets of said City of Arcadia; that Resolution of Intention No. 1900, heretofore adopted by this Council on the 19th day of July, 19~9, contains a complete description of the work and improvement to be done pursuant to this Resolution, and reference is hereby made to said Resolution of Intention No. 1900, for a complete description of s aid work and improvement. SECTION 2. That the grade to which 'the work hereinabove described shall be done and the improvement made as provided in this Resolution is shovm on Profile and Improvement Plan No. C-170, on file in the office of the City Engineer of said City, to which Profile reference is hereby made for the description of such grade. SECTION 3. All of the foregoing work shall be done in ac- cordance with said Profile and Improvement Plan No. C-170, on file in the office of the City Engineer of said City of Arcadia. All work on grading and construction of concrete curbs, gutters and s idevlalks s hall be in accordance with the following 1. o '"~\) \~()~ specifications on file in the office of the City Engineer of said City of Arcadia, to wit: "Standard specifications No. 0 and No.1 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pavement." That all of the foregoing work on the construction of street pavement shall be in accordance with the following specifications on file in the office of the City Engineer of the City of Arcadia, to vii t : "Specific a tions for asphaltic concrete pre-mix pavement and wearing su.rface". Said Profile and Improvement Plan No. C-170 and the Specifi- cations hereinabove referred to were adopted by Resolution No. 1896 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more particular description of said work. All streets and avenues referred to in this Resolution are public streets and avenues of said 'City of Arc adia. SECTION 4. That said contemplated work and improvement in the opinion of the City Council of the City of Arcadia, is of more than local or ordinary public benefit, and said City Council hereby makes the expense of s aid work and improvement chargeable upon the District which District said City Council hereby declares to be assessed to pay the costs and expenses thereof, which said r District shall include ~ll those lots in the said City of Arcadia, County of Los Angeles, state of California, abutting on and adjacent to the said first alley South of Huntington Drive, from a line six feet westerly from and parallel with the easterly line of Santa Anita Avenue to a line twelve feet easterly from and parallel with the westerly line of Second Avenue. A plat or map of said District indicating by boundary line the extent of the lands inc luded in said Dis tric twas approved and adopted by 2. Resolution No. 1895 o~ the City of Arcadia on the 5th day of July, 1949, and is on file in the office of the City Engineer, of the City of Arcadia; reference is hereby made to s aid plat or map for a further, full and complete description of s aid Assessment District, which s aid plat or map is designated as Assessment District No. W-51, and said map so on file s hall govern for all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines and declares that Serial Bonds shall be issued to represent each assessment of Twenty five Dollars ($25.00), or more, remaining unpaid for thirty (30) days after the d ate of the Warrant to represent the expenses of s aid work and improvement. Said Serial Bonds s hall extend over a period ending nine (9) years from the said second day of January next succeeding the next October 15th following their -, date and an even annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after their date, until the whole is paid, and the interes t s hall be payable semi-annually by coupon on the second days of January and July respectively of each year after their d ate a t the rate of six per cent (6%) per armum on all sums unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. All proceedings for the aforesaid work and im- provement and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, lmovm and designated as the "Improvement Act of 1911, being Division 7, Streets and Highways Code of the State of California." SECTION 7. The Arcadia Bulletin, a weekly newspaper of general circulation, published and circulated in said City of 3. " Arcadia, is hereby desi~nated as the newspaper in which notice of said work and improvement inviting sealed proposals shall be published in the manner and form and by the persons required by law. SECTION 8. The City Clerk of said City of Arcadia is hereby directed to post conspicuously for five days, on or near the Council Chamber door of said City Council, in the manner and form required by law, a notice, together with the Specifications there- for, inviting sealed proposals or bids for doing said work and said City Clerk is also directed to publish twice in said news- paper designated as aforesaid in the manner and form required by law, a notice inviting sealed proposals or bids for doing said work, and referring to the Specifications posted or on file. Said notice shall require a certified check or bond, either, as prescribed by law for an amoQ~t not less than ten percent of the aggregate of the proposal. Said sealed proposals or bids shall be delivered to the City Clerk of said City of Arcadia on, or before eight o'clock P.M., on October 4, 1949; bids will be opened on said day and hour. SECTION 9. The City Clerk shall certify to the adoption of this Resolution.
