HomeMy WebLinkAbout1936 RESOLUTION NO. 1936 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AWARDING CONTRACT FOR CER- TAIN.WORK AND IMPROVE1lliNT ON THE FIRST ALLEY SOUTH OF.Hm~TINGTON DRIVE IN SAID CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. ~nEREAS, the City Council of the City of Arcadia did in open session at its regular meeting on October 4, 1949, publicly open, examine and declare all sealed propo- sals or bids for doing certain work and improvement on the first alley south of Huntington Drive, from the easterly line of Santa Anita Avenue to the westerly line of Second Avenue, in said City of Arcadia; that Resolution of Intention No. 1900 heretofore adopted by this Council on the 19th day of JUly, 1949, contains a complete description of said work and improve- ment and reference is hereby made to said Resolution of Inten- tion No. 1900 for a complete description of said work and im- provement. SECTION 2. That the grade to which the work hereinabove described shall be done and the improvement made as provided in this Resolution, is shown on Profile and Improvement Plan No. C- 179, on file in the office of the City Engineer of said City to which Profile reference is hereby made for the description of such grade. SECTION 3. That all of the foregoing work and improve- ment shall be done in accordance with said Profile and Improvement Plan No. C-179, on file in the office of the City Engineer of said City of Arcadia. That all of the foregoing work on grading and the cons- truction of concrete curbs, ~n.d concrete gutters shall be in accordance with the following specifications on file in the office of the City Engineer of the City of Arcadia, to wit: 1. INDEXED "standard SpecificatiomNo. 0 and No.1 for the construction of curbs, sidewalks, gutters, oil macadam and concrete pave- ment." That all of the foregoing work on the construction of street pavement shall be in accordance with the following spe- cifications on file in the office of the City Engineer of the City of Arcadia, to wit: "Specifications for asphalt concrete pre-mix pavement and wearing surface." Said Profile and Improvement Plan No. C-179 and the specifications hereinabove referred to were adopted by Resolu- tion No. 1896 of said City Council of the City of Arcadia, and the same are hereby made a part of this Resolution and are hereby referred to for a more particular description of said work. All avenues and drives referred to in this resolution are public avenues and drives of said City. SECTION 4. That said contemplated work and improvement in the opinion of the City CQuncil of the City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon the District, which district said City Council hereby declares to be the District benefited by said work and improvement and to be assessed to pay the costs and expenses there- of, which said District shall include all those lots in the said City of Arcadia, County of Los Angeles, state of California, abutting on and adjacent to the said first alley South of HYn~ington Drive, from a line six feet (6') westerly from and parallel with the easterly line of Santa Anita Avenue, to a line twelve feet (12') easterly from and parallel with the westerly line of Second Avenue. A plat or map of said District, indicating by a Qoundary line the extent of the lands included in the proposed Assessment 2. District, was approved and adopted by Resolution No. 1895, of the City Council of said City of Arcadia, and is on file in the office of the City Engineer of the City of Arcadia. Refer- ence is hereby made to said plat or map for further, full, and complete description of said Assessment District, which said plat or map is designated as Assessment District No. W-5l, and said map so on file shall govern all details as to the extent of such Assessment District. SECTION 5. Said City Council also determines and de- clares that Serial Bonds shall be issued to represent each assessment of Twenty-five ($25.00) dollars, or more, remaining unpaid for thirty (30) days after the date of the wanrant, to represent the expenses of said work and improvement. Said Serial Bonds shall extend over a period of nine (9) years from the second day of January next succeeding the next October 15th following their date and an even, annual proportion of the principal sum thereof shall be payable by coupon on the second day of January of each year, following the next October 15th after their date, until the whole is paid, and the interest shall be payable semi-annually by coupon on the second days of January and July, respectively, of each year after their date, a t the rate of six (6%) per cent per annum on all sums unpaid until the whole of said principal and interest are paid. Said bonds and interest thereon shall be payable at the office of the City Treasurer of the City of Arcadia. SECTION 6. All of the proceedings for the aforesaid work and improvement and for the issuance of said bonds shall be had and taken under and in accordance with the provisions of an act of the Legislature of the State of California, known and designated as the "Improvement Act of 1911, being Division 7, Streets and Highways Code of the State of California." Reference is hereby made to Resolution of Intention No. 1900 of said City Council, declaring its intention to order 3. said work to be done, for further particulars, which Resolution of Intention is on file in the office of the City Clerk of said City of Arcadia. NOW, THEREFORE, BE IT RESOLVED, that the said City Council hereby rejects all of said proposals or bids except the next herein mentioned and hereby awards the contract for doing said work and improvement to the lowest, regular, responsible bidder therefor, to wit, to JAMES S. WALKER,' at the prices mentioned in its proposal on file for said work and improvement. The City Clerk is hereby directed to publish notice of this award twice in the Arcadia Bulletin, a newspaper of general circulation, published and circulated in the City of Arcadia and hereby designated for that purpose by said City Council. The City Clerk shall certify to the adoption of this --- Resolution.
