RESOLUTION NO. 1938.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING. THE RECOMMENDA-
TION OF THE PLANNING COMMISSION. OF SAID CITY AND
GRANTING A ZONING VARIANCE AFFECTING CERTAIN REAL
PROPERTY LOCATED AT 1016 SOUTH BALDWIN AVENUE,
IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE
AS FOLLOWS:
WHEREAS, on the 31st day of August, 1949, there was
filed with the Planning Commission of the City of Arcadia
the petition of A. Jean Lyman, requesting a zoning variance
on the following described property in the City of Arcadia,
to wit:
The Southerly 72.89 feet of lot 36 and the Northerly
67.11 feet of lot 37, tract No. 3430, as shown on
the map recorded in Book 42, page 32 of Maps, records
of Los Angeles County, said distances being measured
along the Westerly line of said lots,
to permit the above described property to be used for the
conduct of a nursery school, and
WHEREAS, after notice as required by Ordinance No.
760, a public hearing on the matter was held before the said
Planning Commission on the 22nd day of September:;,: 1949, and
all interested parties were given the full opportunity to
be heard, and
WHEREAS, the Planning Commission of the City of Arcadia
recommended to the City Council of the City of Arcadia, in
its Resolution No. 10, that the aforesaid petition be granted
and the requested variance be approved,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
SECTION 1. That the City Council of the City of
Arcadia approve and grant the requested variance for the

following reasons:
(1) The granting of this petition will not be in-
consistent with good planning practice or the provisions
of the Mas ter Zoning Plan, or with the present development
of the neighborhood in which said property is located;
..
(2) The granting of this petition would constitute
merely a continuance of an enterprise which has been operat-
ing in the past through permission previously granted by
variance.
SECTION 2. The Sity Clerk shall certify to the'adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was
adopted at a regular meeting of the City Council of the City
of Arcadia, held on the 1st day of November, 1949, by the
affirmative vote of at least three Councilmen, to wit:
AYES: Councilman Boucher, Klomp, Nugent and Russell
NOES: None
