HomeMy WebLinkAbout1944 RESOLUTION NO. 1944 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE RECO~\lliNDATION OF THE PLJ\J'nUNG COMMISSION OF SAID CITY TO GRANT A PETITION FOR A CONDITIONAL VARIANCE AFFECTING CERTAIN REAL PROPERTY LOCATED ON ViliST HilliTINGTON DRIVE m SAID CITY. Tllli CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: ~~EREAS, on the 17th day of August, 1949, there was filed before the Planning Co~~ission of the City of Arcadia the petition of Rancho Santa Anita, Inc., requesting a zoning variance on the following described property in the City of Arcadia, to wit: That portion of lot 5, tract No. 949, as shown on map recorded in book 17, page 13 of maps, records of Los Angeles County, California, bounded on the northwest by Huntington Drive; on the northeast by the property of the Los Angeles Turf Club; on the southeast by the Pacific Electric Railway, and on the southwest by Holly Avenue, to permit the conduct of a golf driving range, miniature golf range, pitch and putt go~f course, badminton courts, ping-pong courts, archery range, tennis courts, and the purveying of re- freshments usually associated with and sold at a public golf course, and WHEREAS, said property is now located in a residential zone, to wit, R-3 Zone, and ~~EREAS, after notice as required by Ordinance No. 760, a public hearing on the matter was held before the Planning Commission of the City of Arcadia on the 22nd day of September, 1949, and all interested parties were given a full opportunity to be heard, and 1. "'0"",,0 ~ WHb~EAS, in the opinion of the Planning Commission the lnaintenance of the several cormnercial uses hereinbefore enumerated in this R-3 zone would not be detrimental to the public welfare nor injurious to surrounding property, nor adversely affect the comprehensive general plan of the City of Arcadia, and i~rlEREAS, the Planning Coa~ission of the City of Arcadia recommended in its Resolution No. 11, dated the 6th day of Octo- ber, 1949, that the aforesaid petition be approved and granted, subject to the following terms and conditions, 1. That the aforesaid property be used for the conduct of a golf driving range, miniature golf range, pitch and putt golf course, badminton courts, ping-pong courts, archery range, tennis courts and the purveying of refres~~ents usually associated with and sold at a public golf course, and for no other purpose or purposes not permitted in Zone R-3 of the City of Arcadia; 2. That the variance hereby granted shall terminate, cease and have no further effect on and after October 11, 1954; 3. That the business operations hereinbefore enumerated and for which this variance is recommended will not be conducted between the hours of 2olclock a.m. and 6 o'clock a.m. on any day; 4. That no alcoholic beverages, including wine and beer, will be kept or sold upon the aforesaid premises; 5. That in case anyone or more of the provisions or conditions of this Resolution are violated, the property above described shall revert to Zone R-3, as defined in said Ordinance No. 760, and all of the rights and privileges herein granted shall cease and terminate, in the event that any such violation is not terminated within thirty days, or such further time as the City Council may decide that the owners of said property, in the exercise of due diligence, reguire to correct such violation, after the oymers of said property have been given notice in writing by the City Council of said violation; 2. 6. That the rights and privileges granted by the Re- solution of the Planning Commission are accepted by the persons affected thereby upon the foregoing express conditions; A~ID WHEREAS, the aforesaid Resolution No. 11 of the Planning Commission of the City of Arcadia was adopted by the Commission on the 6th day of October, 1949, NOW, THEREFORE, BE IT RESOLVETI AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia does hereby approve and adopt the foregoing recommendations of the Planning Commission, aa set forth in said Resolution No. 11 of said Commission, and does hereby grant to petitioner a condi- tional zoning variance affecting the real property hereinbefore described, subject to the terms and conditions in said Resolu- tion expressly enumerated. SECTION 2. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 15th of November, 1949, by the affir- mative vote of at least three Councilmen, to wit: AYES: Councilman Boucher, Klomp} Nugent and Russell NOES: None ABSENT: Councilman Libby ~ City Clerk of the City Arcadia SIGNED AND APPROVED THIS FIFTEENTH DAY OF~( .--'.
